Overview
The Appropriation (Parliamentary Departments) Act (No. 2) 1987-88 was enacted by the Australian Parliament to address the need for additional appropriations for certain parliamentary departments for the financial year ending 30 June 1988. This Act was necessitated by the requirement to allocate funds beyond those initially appropriated by the Appropriation (Parliamentary Departments) Act 1987-88. Authorising the Minister for Finance to issue an additional sum of $308,000 from the Consolidated Revenue Fund, the Act ensures that these funds are specifically applied to the services detailed in the accompanying schedule, which includes the Parliamentary Library. The appropriation is deemed to have been in effect from 1 July 1987, aligning with the financial year in question. The underlying policy objective is to facilitate the necessary funding for parliamentary operations, ensuring continuity and efficiency in the services provided by these departments.
Scope and Application
The Appropriation (Parliamentary Departments) Act (No. 2) 1987-88 is a Commonwealth Act that provides for the appropriation of additional funds out of the Consolidated Revenue Fund for specified services relating to parliamentary departments. This Act applies specifically to the financial year ending on 30 June 1988 and concerns the appropriation of $308,000 for the Parliamentary Library. It is intended to supplement the appropriations already made by the Appropriation (Parliamentary Departments) Act 1987-88, and the funds are deemed to have been appropriated as from 1 July 1987. The Act does not explicitly state exclusions, exemptions, or thresholds, but it does specify the services for which the appropriation is intended, namely the Parliamentary Library. The Act's application is limited to the Commonwealth jurisdiction, and its scope does not extend beyond the appropriation of additional funds for the specified services within the given financial year. Any further detail or application beyond the scope of this Act would likely be addressed through subordinate instruments or related legislation.
Key Provisions
The Appropriation (Parliamentary Departments) Act (No. 2) 1987-88, referred to in section 1, is an Act that authorises the issuance of additional funds from the Consolidated Revenue Fund for specific services during the year ending on 30 June 1988. Section 3 of the Act allows the Minister for Finance to issue and apply $308,000 for the services outlined in the Schedule, which, in this case, pertains to the Parliamentary Library. The Act also includes a provision in section 4 that specifies the appropriation of this sum as from 1 July 1987. Section 5 extends the application of section 5 of the Appropriation (Parliamentary Departments) Act 1987-88 to include the Schedule of this Act, thus incorporating any necessary references to additional appropriations.
The Act imposes certain obligations and requirements on the Minister for Finance and other relevant parties. Primarily, the Minister for Finance must ensure that the funds are issued and applied strictly for the services specified in the Schedule, which, for this Act, is limited to the Parliamentary Library. This obligation is clearly stated in section 3, which grants the authority to issue the funds and stipulates the purpose of the appropriation. Additionally, the Act necessitates that the appropriation be accounted for within the financial year starting on 1 July 1987, as indicated in section 4. Compliance with these provisions is essential to ensure that the allocated funds are used as intended and within the prescribed timeframe.
Regarding the consequences of breaching the provisions of this Act, there are no explicit criminal or civil penalties outlined within the text of this specific Act. However, it is important to note that breaches of appropriation acts can generally lead to significant consequences under broader legislative frameworks. In practice, misuse of public funds or failure to adhere to the stipulated purposes of an appropriation could result in disciplinary actions, legal proceedings, or other administrative consequences. The severity of these outcomes would depend on the nature and extent of the breach, as well as the broader legal context in which it occurs.
