Overview

The Appropriation (Parliamentary Departments) Act (No. 2) 1982-83 was enacted to provide additional funding beyond what was originally appropriated by the Appropriation (Parliamentary Departments) Act 1982-83 for the fiscal year ending 30 June 1983. This Act was introduced to address the financial needs of the Parliamentary Departments for that specific year, particularly focusing on the House of Representatives. Enacted by the Queen, in accordance with the authority of the Senate and the House of Representatives of the Commonwealth of Australia, the policy objective of this Act was to ensure that the Parliamentary Departments had sufficient funds to operate effectively. The Act authorizes the Minister for Finance to issue an additional sum of $288,000 from the Consolidated Revenue Fund for the specified services of the year, with the appropriation deemed to have been made from 1 July 1982. This additional funding was crucial to meet the increased financial demands of the parliamentary operations for the year in question.

Scope and Application

The Appropriation (Parliamentary Departments) Act (No. 2) 1982-83 is an Australian Commonwealth Act that appropriates additional funds from the Consolidated Revenue Fund for the financial year ending 30 June 1983. The Act applies specifically to the allocation of funds for the services of the House of Representatives, as outlined in the attached Schedule. This appropriation is intended to cover recurrent expenditures, as detailed in the legislative text, and supplements the initial appropriation made by the Appropriation (Parliamentary Departments) Act 1982-83. The Act does not specify exclusions or exemptions beyond the scope of its appropriation function, and its application is limited to the financial year specified, with no provisions noted for extensions or restrictions through subordinate instruments. The Act comes into operation on the day it receives Royal Assent, ensuring that the additional funds are available for the intended parliamentary services from the commencement date.

Key Provisions

The Appropriation (Parliamentary Departments) Act (No. 2) 1982-83 (the "Act") is designed to provide an additional appropriation for the year ending on 30 June 1983, specifically for the House of Representatives, in addition to the sums already allocated in the Appropriation (Parliamentary Departments) Act 1982-83. The Act authorizes the Minister for Finance to issue and apply $288,000 out of the Consolidated Revenue Fund for the services specified in the Schedule (section 3). This sum is to be used for the financial year commencing on 1 July 1982 (section 4). It is also noteworthy that the Act includes an additional appropriation to account for increases in salaries, as specified in section 5 of the Appropriation (Parliamentary Departments) Act 1982-83, which now also references the Schedule to this Act. The obligations imposed by this Act on the Minister for Finance are primarily financial in nature. The Minister is tasked with ensuring that the additional funds are issued and applied strictly for the services listed in the Schedule, specifically for the House of Representatives. This includes ensuring that the funds are used for recurrent expenditures as outlined. The Act also necessitates that the additional appropriation be accounted for in the context of increases in salaries, as indicated in the reference to section 5 of the previous Act. The Minister must comply with the financial management and appropriation processes as stipulated by the Act. In terms of consequences for breach, the Act does not explicitly outline specific offences, penalties, or civil or criminal consequences for non-compliance with its provisions. However, it is implicit that any misuse or misapplication of the appropriated funds could lead to financial mismanagement or misallocation, which could have administrative or legal repercussions. The Act's focus is on the appropriation and application of funds, and any failure to adhere to the specified use of the funds could potentially result in financial oversight issues, which might be addressed under broader financial management laws or regulations.
