An Act to appropriate a sum out of the Consolidated Revenue Fund, additional to the sums appropriated by the Appropriation Act (No. 2) 1991-92, for certain expenditure in respect of the year ending on 30 June 1992, and for related purposes

The Parliament of Australia enacts:
Short title
1. This Act may be cited as the Appropriation Act (No. 4) 1991-92.
Commencement
2. This Act commences on the day on which it receives the Royal Assent.
Issue and application of $277 064 000
3. The Minister for Finance may issue out of the Consolidated Revenue Fund and apply for the services specified in Schedule 2, in respect of the year ending on 30 June 1992, the sum of $277 064 000.

Appropriation of $277 064 000
4. The sum authorised by this Act to be issued out of the Consolidated Revenue Fund is appropriated, and is taken to have been appropriated as from 1 July 1991, for the services specified in Schedule 2 in respect of the year that commenced on that day.
Payments to States
5. (1) In this section and in determinations for the purposes of paragraph (2)(a) or (b):
"Appropriation Act" means an Act appropriating money for expenditure in respect of a financial year and includes an Act appropriating money, by way of interim provision, for such expenditure.
(2) Payments out of such money appropriated by this Act as is specified in the Division, or unit of a Division, in Schedule 2 that is specified in column 2 of an item in Schedule 1, being payments that are made to a State for a purpose specified in column 3 of that item, must be made:
(a) on such terms and conditions (if any) as are from time to time determined, in writing, for the purposes of Appropriation Acts, by the Minister specified in column 4 of that item, as being terms and conditions applicable to payments under such Acts to a State for that purpose; and
(b) in such amounts and at such times as are determined, in writing, by the Minister specified in column 5 of that item.
(3) Payments to a State out of such of the money appropriated by this Act as is specified in Division 977 in Schedule 2 must be made in accordance with any determinations of the Treasurer as to the amounts and times of payments.
(4) Nothing in this section limits, by implication, the power of the Commonwealth to make payments to a Territory, a local Government body, a body corporate, an organisation or a natural person for any purposes for which money is appropriated under Appropriation Acts:
(a) on such terms and conditions; and
(b) in such amounts and at such times;
as the Commonwealth determines.
Money appropriated for a program
6. Where money is appropriated by this Act for a particular program, that money is taken to be appropriated for:
(a) the purpose of payments (including advances) under Acts administered as part of the program; and
(b) any other purposes of the program.
Department of Administrative Services
7. The Appropriation Act (No. 2) 1991-92 has effect, and is taken at all times to have had effect, as if the reference to "Loan Facility" in item 2 of subdivision 2 of Division 805 in Schedule 4 to that Act were a reference to "Contingency Funding".
Department of the Arts, Sport, the Environment and Territories
8. The Appropriation Act (No. 2) 1991-92 has effect, and is taken at all times after 26 December 1991 to have had effect, as if:
(a) the appropriation of an amount to the Department of the Arts, Sport the Environment, Tourism and Territories under item 3 of subdivision 1 of Division 811 in Schedule 4 to that Act were:
(i) an appropriation to that Department of so much of that amount as is equal to the total of the payments made before 27 December 1991 out of money appropriated under that item; and
(ii) the appropriation of the balance of that amount to the Department of Tourism for the purpose specified in that item; and
(b) the appropriation of an amount to the Department of the Arts, Sport, the Environment, Tourism and Territories:
(i) under an item (other than the item referred to in paragraph ister for (a)) of a subdivision of a Division in Schedule 4 to that Act; or
(ii) if a subdivision of a Division in that Schedule is not further divided into items — under that Subdivision;
were:
(iii) an appropriation to that Department of so much of that amount as is equal to the total of the payments made before 27 December 1991 out of money appropriated under that item or subdivision; and
(iv) an appropriation of the balance of that amount to the Department of the Arts, Sport, the Environment and Territories for the purposes specified in that item or subdivision.
Attorney-General's Department
9. If a body to be known as the Australian Transactions Reports and Analysis Centre is established by legislation during the year ending on 30 June 1992, the Appropriation Act (No. 2) 1991-92 has effect, and is taken at all times to have had effect, as if the appropriation of an amount to the Attorney-General's Department under item 5 in subdivision 1 of Division 818 in Schedule 4 to that Act were:
(a) an appropriation to that body of so much of that amount as is determined, in writing, by the Minister for Finance to be required for the purposes of that body in respect of the period commencing on the establishment of the body and ending on 30 June 1992; and
(b) an appropriation of the balance of that amount to the Department for the purpose of meeting expenses for acquisitions, buildings, works, plant and equipment (as the case may be) incurred by the Department preparatory to the establishment of the body.
