Appropriation Act (No. 4) 1988-89

No. 44 of 1989

An Act to appropriate a sum out of the Consolidated Revenue Fund, additional to the sum appropriated by the Appropriation Act (No. 2) 1988-89, for certain expenditure in respect of the year ending on 30 June 1989, and for other purposes

[Assented to 2 June 1989]

BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows:

Short title

1. This Act may be cited as the Appropriation Act (No. 4) 1988-89.

Commencement

2. This Act commences on the day on which it receives the Royal Assent.

Issue and application of $68,359,000

3. The Minister for Finance may issue out of the Consolidated Revenue Fund and apply for the services specified in Schedule 2, in respect of the year ending on 30 June 1989, the sum of $68,359,000.

Appropriation

4. The sum authorised by this Act to be issued out of the Consolidated Revenue Fund is appropriated, and shall be deemed to have been appropriated as from 1 July 1988, for the services specified in Schedule 2 in respect of the financial year that commenced on that date.

Payments to States

5. (1) In this section and in determinations for the purposes of paragraph (2)(a) or (b):

"Appropriation Act" means an Act appropriating money for expenditure in respect of a financial year and includes an Act appropriating money, by way of interim provision, for such expenditure.

(2) Payments out of such of the money appropriated by this Act as is specified in the Division, or unit of a Division, in Schedule 2 that is specified in column 2 in an item in Schedule 1, being payments that are made to a State for a purpose specified in column 3 in that item, shall be made:

(a)    on such terms and conditions (if any) as are from time to time determined, in writing, for the purposes of Appropriation Acts by the Minister specified in column 4 in that item as being terms and conditions applicable to payments under such Acts to a State for that purpose; and

(b)    in such amounts and at such times as are determined, in writing, by the Minister specified in column 5 in that item.

(3)      Payments to a State out of such of the money appropriated by this Act as is specified in Division 977 in Schedule 2 shall be made in accordance with any determinations of the Treasurer as to the amounts and times of payments.

(4)      Nothing in this section shall be taken to limit, by implication, the power of the Commonwealth to make payments to a Territory, a local Government body, a body corporate, an organisation or a natural person for any purposes for which money is appropriated under Appropriation Acts:

(a)    on such terms and conditions; and

(b)    in such amounts and at such times;

as the Commonwealth determines.

 

Money appropriated for a program

6. Where money is appropriated by this Act for a particular program, that money shall be taken to be appropriated for:

(a)    the purpose of payments (including advances) under Acts administered as part of the program; and

(b)    other purposes of the program, being purposes for which appropriation has been made in an earlier Act.

Australian Capital Territory Trust Account

7. The Appropriation Act (No. 2) 1988-89 has effect, and shall be taken to have had effect at all times after its commencement as if the reference in subsections 7 (2) and (3) to the Schedule were references to Schedule 4.


Department of Administrative Services—plant and equipment

8. The Appropriation Act (No. 2) 1988-89 has effect, and shall be taken to have had effect at all times after its commencement, as if:

(a)    the item described as item 7 of subdivision 7 of Division 805 of Schedule 4 to that Act had been described as item 6 of that subdivision;

(b)    the item described as item 6 of that subdivision had been described as item 7 of that subdivision;

(c)    any money that was issued and applied before the commencement of this subsection for the purposes of the item described as item 6 of that subdivision had been properly issued and applied for those purposes under item 7 of that subdivision; and

(d)    any money that was issued and applied before the commencement of this subsection for the purposes of the item described as item 7 of that subdivision had been properly issued and applied for those purposes under item 6 of that subdivision.

Defence Service Homes Corporation

9. The Appropriation Act (No. 2) 1988-89 has effect, and shall be taken to have had effect at all times after its commencement, as if:

(a)    subdivision 3 of Division 842 of Schedule 4 to that Act were omitted from that Act; and

(b)    any amount that is specified in that Act and that incorporates the sum of $40,500,000, appropriated under that subdivision were reduced by that amount.
