Overview

The Appropriation Act (No. 4) 1982-83, enacted by the Parliament of Australia, was introduced to provide additional funding beyond what was originally appropriated by the Appropriation Act (No. 2) 1982-83 for the year ending on 30 June 1983. This supplementary appropriation was necessitated to address specific financial requirements arising during the financial year. The Act authorises the Minister for Finance to issue and apply a total sum of $196,012,000 from the Consolidated Revenue Fund for specified services, with a significant portion allocated to the Department of Finance for natural disaster relief and restoration efforts. The policy objective of this Act is to ensure that adequate funds are available to support the Commonwealth's response to natural disasters, particularly in states affected by bushfires, thus reinforcing the government's commitment to disaster relief and restoration.

Scope and Application

The Appropriation Act (No. 4) 1982-83 is a piece of Commonwealth legislation that authorises the appropriation and issuance of a specific sum of money from the Consolidated Revenue Fund for particular services within the financial year ending on 30 June 1983. This Act applies to the Minister for Finance and the Treasurer, who are empowered to issue and apply the appropriated funds for the services specified in the Act's Schedule. The geographic and jurisdictional reach of this Act is limited to the Commonwealth level, as it pertains to the appropriation of funds for services rendered by the Commonwealth government during the stated financial year. The Act includes provisions for payments to states and territories for natural disaster relief and restoration, with specific terms and conditions determined by the Minister for Finance and the Treasurer. The Act does not explicitly state any exclusions or thresholds, but it does provide for additional appropriations beyond those specified in the Appropriation Act (No. 2) 1982-83. Any further implementation or modifications to the Act’s application would be made through subordinate instruments as determined by the Minister for Finance or the Treasurer.

Key Provisions

The Appropriation Act (No. 4) 1982-83 (section 3) authorises the Minister for Finance to issue and apply the sum of $196,012,000 out of the Consolidated Revenue Fund for specified services for the year ending on 30 June 1983. This appropriation is deemed to have been made from 1 July 1982, for the services detailed in the Schedule (section 4). The Schedule outlines the allocation of funds between the Department of Finance and the Department of the Treasury, with the Department of Finance receiving the majority of the funds for natural disaster relief and restoration, and the Department of the Treasury receiving funds for general purpose assistance in Victoria and South Australia related to bushfires. The Act imposes obligations on the Minister for Finance and the Treasurer regarding the terms and conditions of payments to states and the Northern Territory for natural disaster relief and restoration (section 5(1)). Payments are to be made on terms determined by the Minister for Finance, and in accordance with any determinations by the Minister regarding the amounts and times of payments. Similarly, payments to Victoria and South Australia for bushfires are to be made on terms determined by the Treasurer, and according to any determinations by the Treasurer regarding the amounts and times of payments (section 5(2)). These obligations ensure that the payments are made in a structured and controlled manner, as per the Act’s stipulations. There are no explicit offences, penalties, or consequences for breach detailed within the Act itself. However, breaches of the terms and conditions specified by the Minister for Finance or the Treasurer, or failure to comply with their determinations regarding payments, could potentially lead to legal consequences under other relevant legislation or administrative law principles. The Act primarily focuses on the appropriation of funds and the manner in which these funds are to be issued and applied, without detailing specific penalties for non-compliance with its provisions.
