Overview

The Appropriation Act (No. 4) 1968–69, enacted by the Parliament of Australia, serves to allocate an additional sum from the Consolidated Revenue Fund for the financial year ending 30 June 1969. This Act supplements the appropriations made by the Appropriation Act (No. 2) 1968–69, addressing the need for further funding beyond what was initially allocated. The total amount authorised for issue and application is $21,754,000, intended for various services as detailed in the Act's schedule, which includes allocations for departments such as Customs and Excise, External Affairs, Health, and the Treasury, among others. The policy objective is to ensure that the government can meet its commitments and operational needs for the specified financial year. The Act provides the necessary legal framework for the Treasurer to disburse funds for these services, ensuring that the government can continue to function effectively and provide the required services to the public. By appropriating these funds, the Act facilitates the operational continuity of various governmental departments and services for the year in question.

Scope and Application

The Appropriation Act (No. 4) 1968–69 applies to the Commonwealth of Australia and authorises the Treasurer to issue funds from the Consolidated Revenue Fund to be applied for specified services across various departments and entities for the financial year ending on 30 June 1969. The Act provides appropriations for a broad range of government activities, including capital works, equipment purchases, and administrative expenses for departments such as Customs and Excise, External Affairs, Health, and others. The geographical scope of the Act covers federal entities as well as international and state-related services, reflecting the wide-ranging responsibilities of the Commonwealth government at the time. The Act does not explicitly state any exclusions, exemptions, or thresholds; however, it does detail specific allocations to various departments and services as outlined in the attached schedule. The application of the Act may be extended or modified through subordinate instruments, such as regulations or orders, which would provide further detail on the specific implementation of the appropriations.

Key Provisions

The Appropriation Act (No. 4) 1968–69 (sections 1-4) provides the legal framework for the appropriation of funds from the Consolidated Revenue Fund for specific services during the financial year ending on 30 June 1969. The Act authorises the Treasurer to issue and apply a total of $21,754,000 for the services detailed in the accompanying Schedule. This sum is deemed to have been appropriated as from 1 July 1968. The primary sections of the Act (sections 3 and 4) outline the issuance and application of the appropriated funds, as well as the appropriation itself, which is allocated to various government departments and services. The Act imposes several obligations on the parties it governs. Most notably, it mandates the Treasurer to issue the specified sum from the Consolidated Revenue Fund and apply it strictly to the services outlined in the Schedule. This includes detailed allocations for departments such as Customs and Excise, External Affairs, and Health, among others. Each department must ensure that the funds are used exclusively for the purposes for which they were appropriated, in accordance with the detailed budget allocations provided in the Schedule. Failure to adhere to the provisions of the Appropriation Act (No. 4) 1968–69 may result in significant legal consequences. While the Act itself does not explicitly outline specific penalties for breaches, misuse of appropriated funds generally falls under broader financial and public administration laws. Such breaches could lead to civil or criminal liabilities, including potential fines or imprisonment, depending on the severity of the misconduct. The Act’s provisions are intended to ensure financial accountability and transparency in the use of public funds, thereby protecting the interests of the Commonwealth and its citizens.
