Overview
The Appropriation Act (No. 3) 1985-86 was enacted in 1986 by the Australian Parliament to provide additional funds for the Commonwealth's expenses during the financial year ending on 30 June 1986. This Act supplements the funds previously allocated by the Appropriation Act (No. 1) 1985-86. Authorising the Minister for Finance to issue an additional $755,656,000 from the Consolidated Revenue Fund, it ensures that these funds are specifically earmarked for the services outlined in its Schedule, which includes various government departments and their respective expenses for the year. The Act is designed to operate from the date of receiving Royal Assent, ensuring timely financial provisions for government operations. Furthermore, it incorporates provisions to adjust for increases in salaries and is subject to the constraints and requirements outlined in the Loan Act 1985.
Scope and Application
The Appropriation Act (No. 3) 1985-86 applies to the appropriation of funds from the Consolidated Revenue Fund for the financial year ending on 30 June 1986. The Act authorises the Minister for Finance to issue and apply the sum of $755,656,000 for the services specified in the Schedule, which includes allocations for various government departments and services. The appropriation is subject to the conditions of the Loan Act 1985, and the Act itself comes into operation upon receiving Royal Assent. The appropriation applies to the Commonwealth of Australia, affecting all departments and services listed in the Schedule, which is extensive, covering a wide array of governmental activities and sectors from Defence to Social Security. There are no exclusions or exemptions specified within the Act itself, but its application is constrained by the parameters set out in the Loan Act 1985.
Key Provisions
The main operative sections of the Appropriation Act (No. 3) 1985-86 (sections 3 and 4) permit the Minister for Finance to issue a sum of money from the Consolidated Revenue Fund and appropriate this sum for specified services. The issuance and application of the funds ($755,656,000) are to be used for services as detailed in the Schedule for the financial year ending on 30 June 1986. The appropriation of these funds is deemed to have been effective from 1 July 1985. Section 5 of the Act ensures that any increases in salaries are also covered by this appropriation.
The Act imposes obligations on the Minister for Finance to ensure that the funds are issued and applied strictly in accordance with the services detailed in the Schedule. The Minister must also ensure that any additional appropriation required for salary increases is covered by this Act, as per the reference made to the Appropriation Act (No. 1) 1985-86. Furthermore, the Act is subject to the provisions of the Loan Act 1985, meaning any issuance of funds must comply with the requirements of that Act.
Breach of the obligations set out in the Appropriation Act (No. 3) 1985-86 may result in various civil or criminal consequences. While the Act itself does not specify penalties for non-compliance, breaches of appropriation laws generally could lead to legal action, financial penalties, or other civil remedies. The severity of the consequences would depend on the specific nature of the breach and the jurisdiction under which the Act is enforced. However, it is worth noting that the Act’s purpose is to ensure that public funds are used responsibly and in accordance with parliamentary intent, and failure to adhere to these requirements could result in significant legal repercussions.
