Overview

The Appropriation (No. 3) Act 1965–66 was enacted to provide additional funding for the Commonwealth Government for the financial year ending 30 June 1966, supplementing the sums already appropriated by the Appropriation Act (No. 1) 1965–66. The Act was passed by the Queen, through the authority of the Australian Parliament, and received Royal Assent on 18 May 1966. It addresses the need for further appropriation of funds to meet the requirements of various government departments and services beyond what was initially allocated. The Act authorises the Treasurer to issue and apply a total sum of $67,688,000 from the Consolidated Revenue Fund for specified services detailed in the schedule, deemed to have been appropriated from 1 July 1965.

Scope and Application

The Appropriation Act (No. 3) 1965–66 is an Australian Commonwealth Act that authorises the appropriation of a sum out of the Consolidated Revenue Fund for the specified services for the year ending 30 June 1966. This Act applies to the financial year that commenced on 1 July 1965, and it comes into operation on the day it receives the Royal Assent. The Act allows the Treasurer to issue and apply the sum of $67,688,000 for the services detailed in the Schedule, which includes appropriations for various departments and services such as the Department of Defence, Department of Health, and the Australian Capital Territory, among others. This Act applies to the Commonwealth and its various departments and territories, with the specified allocation for each entity detailed in the Schedule. There are no exclusions or exemptions mentioned in the Act, and it extends its application through the Schedule which lists the departments and services for which the funds are appropriated.

Key Provisions

The Appropriation Act (No. 3) 1965–66 (sections 1 to 4) sets out the provisions for the appropriation of funds for government services for the financial year ending June 30, 1966. Section 1 provides the short title of the Act, while Section 2 states that the Act will come into operation on the day it receives Royal Assent. Section 3 authorises the Treasurer to issue and apply the sum of $67,688,000 from the Consolidated Revenue Fund for the specified services in the Schedule. Section 4 appropriates this sum for the services detailed in the Schedule, deemed to have been appropriated from July 1, 1965. The Act imposes obligations on the Treasurer to ensure the appropriated funds are used strictly for the services detailed in the Schedule, which includes various government departments, services, and territories. The Treasurer must adhere to the specific allocations for each department and service, ensuring no deviation from the outlined budget for the financial year. Breaches of the Act, where funds are not used as appropriated, may result in financial mismanagement or misallocation, leading to potential legal consequences. Although the Act does not explicitly state penalties, unauthorised use of funds could result in civil or criminal liability under other relevant legislation, such as the Public Governance, Performance and Accountability Act 2013. The penalties for such breaches could range from fines to imprisonment, depending on the severity of the misconduct and the specific provisions of other applicable laws.
