Overview

The Appropriation Act (No. 2) 1967–68 was enacted by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia to appropriate funds from the Consolidated Revenue Fund for specified expenditures during the financial year ending on 30 June 1968. This Act was introduced to address the need for the allocation and control of public funds to various departments and services as stipulated by the Commonwealth. Authorised by the Supply Act (No. 2) 1967–68, the Act facilitates the issuing and application of a total sum of $601,559,000, which includes funds authorised under the Supply Act and this Act. The policy objective is to ensure that the financial resources are appropriately allocated to meet the Commonwealth's service delivery needs for the specified period.

Scope and Application

The Appropriation Act (No. 2) 1967–68 is a Commonwealth legislative instrument that allocates a specified sum from the Consolidated Revenue Fund for the financial year ending on the 30th of June 1968. This Act applies to the appropriation of funds for various services and departments of the Commonwealth government, including entities such as the Department of Civil Aviation, the Commonwealth Scientific and Industrial Research Organisation, and the Department of Education and Science. The geographic scope of the Act is nationwide as it pertains to the Commonwealth government. The Act does not explicitly state any exclusions or exemptions, but rather directs the allocation of funds towards specific services and departments as outlined in the Second Schedule. The Act itself does not extend or restrict application through subordinate instruments, as its purpose is to appropriate funds as specified in the schedules. The Act came into operation on the day it received Royal Assent, which was on the 31st of October 1967.

Key Provisions

The main operative sections of the Appropriation Act (No. 2) 1967–68 (C1967A00067) authorise the appropriation and issue of funds from the Consolidated Revenue Fund. Specifically, section 3 allows the Treasurer to issue and apply a sum of $366,461,000 for services specified in the Second Schedule for the financial year ending June 30, 1968. Section 4 provides for the appropriation of the total sum of $601,559,000, which is the aggregate of the funds authorised by the Supply Act (No. 2) 1967–68 and this Act, for the same services as specified in the Second Schedule, and it is deemed to have been appropriated as from July 1, 1967. The schedules detail the specific allocations to various departments and services, including both government departments and business undertakings. The obligations and requirements imposed by the Act on the parties it governs are primarily financial in nature. The Act mandates that the funds appropriated be used strictly for the services outlined in the Second Schedule. Each department and entity listed in the schedule is responsible for ensuring that the allocated funds are utilised in accordance with the services specified and within the limits of the amounts appropriated. This includes adhering to the budgetary controls and financial regulations set forth by the government to ensure the proper application of the appropriated funds. The Act does not explicitly detail offences, penalties, or civil/criminal consequences for breach of its provisions. However, breaches of financial and budgetary laws in Australia, generally, can lead to significant legal consequences. In cases where funds are misused or misappropriated, individuals and entities can face civil penalties, including financial penalties or the requirement to repay the misused funds. Criminal charges may also be pursued, particularly in cases of fraud or embezzlement, which can result in fines and imprisonment. The specific penalties would depend on the nature and severity of the breach, as well as other applicable laws.
