Overview

The Appropriation Act (No. 2) 1948-49, enacted in 1949, is a legislative measure by the Parliament of Australia designed to grant and apply an additional sum from the Consolidated Revenue Fund for the financial year ending 30 June 1949. This Act was enacted to ensure that the government had the necessary funds to meet the expenditures required for the services of that year. The Act authorises the Treasurer to issue and apply the sum of £16,900,000 towards the supply granted to His Majesty for the service of the year. The appropriation is deemed to have been made as from the first day of July 1948 and is allocated to various departments and services as detailed in the Schedule attached to the Act. The policy objective of this Act is to provide the financial resources necessary for the government to continue its operations and services for the specified financial year.

Scope and Application

The Appropriation Act (No. 2) 1948-49 applies to the Commonwealth of Australia and authorises the issuance and application of a specific sum from the Consolidated Revenue Fund for the financial year ending 30 June 1949. The Act authorises the Treasurer to issue and apply £16,900,000 from the Consolidated Revenue Fund to cover the supply granted to His Majesty for the specified financial year. This sum is deemed to have been appropriated as from 1 July 1948, and is allocated towards various government departments and services as detailed in the Schedule. The Act specifies allocations for Defence and Post-war (1939-45) Charges, Miscellaneous Services, War (1914-18) Services, and Business Undertakings such as the Postmaster-General's Department. Certain amounts are designated as unexpended at the end of the financial year. The Act's jurisdiction is limited to the Commonwealth level, and while it provides a detailed appropriation framework, it does not specify exclusions or exemptions. The Act may be supplemented by subordinate instruments to further detail the application of these appropriations.

Key Provisions

The main operative sections of the Appropriation Act (No. 2) 1948-49 (section 1) grant and apply an additional sum out of the Consolidated Revenue Fund for the service of the year ending June 30, 1949, and appropriate that sum. Section 2 specifies the Act's commencement date as the day it receives Royal Assent. Section 3 empowers the Treasurer to issue and apply up to £16,900,000 from the Consolidated Revenue Fund to cover the supply granted to His Majesty for the specified year. Section 4 appropriates the sum granted by the Act, deemed to have been appropriated from July 1, 1948, for the purposes and services detailed in the Schedule. The Act imposes obligations and requirements on various departments and services. The Treasurer must ensure the funds are issued and applied correctly as per Section 3. Departments and services must adhere to the allocations specified in the Schedule for the financial year 1948-49. This includes Defence and Post-war (1939-45) Charges, Miscellaneous Services, and War (1914-18) Services, among others. The Postmaster-General's Department, classified under business undertakings, must also comply with its specified allocation. Any breaches of the Act's provisions may lead to civil or criminal consequences. Although specific penalties are not detailed in the provided text, violations of appropriation acts generally attract penalties under the Public Service Act 1922 and other related legislation. These can include fines, imprisonment, or both, depending on the severity and nature of the breach. The maximum penalties can vary widely, from fines up to several thousand Australian dollars to imprisonment terms that can extend to several years, depending on the offence and jurisdiction.
