Overview
The Appropriation Act (No. 2) 1941–42 was enacted by the Parliament of Australia to address the financial needs of the nation during a period of significant national crisis, specifically the exigencies of World War II. The Act authorises the issuance and application of £25,000,000 from the Consolidated Revenue Fund to meet the supply granted to His Majesty for the fiscal year ending 30 June 1942, primarily allocated towards defence and war services. The Act aims to ensure that the necessary funds are available to support the nation's war efforts by appropriating the granted sum from 1 July 1941. The policy objective of this legislation is to provide the financial resources required to sustain the nation's involvement in the war, reflecting the pressing need to support military operations and related services during a time of national emergency.
Scope and Application
The Appropriation Act (No. 2) 1941–42 applies to the Commonwealth of Australia and authorises the Treasurer to issue and apply up to £25 million from the Consolidated Revenue Fund for the financial year ending 30 June 1942. This appropriation is directed towards making good the supply granted to His Majesty for the specified financial year and is detailed in the schedule attached to the Act. The funds are intended for various purposes and services, primarily related to Defence and War services for the period 1939–1941, as outlined in the schedule. The Act itself does not specify exclusions, exemptions, or thresholds, but the detailed allocation of funds is outlined in the accompanying schedule. The Act extends its application through subordinate instruments, which would detail the specific allotment of funds to particular services as mentioned in the schedule.
Key Provisions
The Appropriation Act (No. 2) 1941–42, which received Royal Assent on 12th June 1942, establishes the financial allocation for the Commonwealth of Australia for the year ending 30th June 1942. The primary operative sections of this Act include Section 3, which authorises the Treasurer to issue £25,000,000 from the Consolidated Revenue Fund to meet the supply granted for the financial year. Section 4 then appropriates this sum, specifying that it is deemed to have been appropriated as from 1st July 1941. The specific allocations for various services and departments are detailed in the Schedule, with a notable allocation of £25,000,000 for Defence and War Services.
The Act imposes several obligations on the relevant parties, primarily the Treasurer. Under Section 3, the Treasurer is authorised to issue the specified sum from the Consolidated Revenue Fund, ensuring that the financial resources are made available for the designated purposes. The appropriation outlined in Section 4 ensures that the funds are allocated as intended, providing clarity and direction for financial management within the stipulated timeframe. The Schedule further details the specific allocations, providing a framework for how the funds should be distributed across different services and departments.
Breaches of the provisions in this Act could have significant consequences. Although the Act itself does not explicitly detail offences, penalties, or consequences for non-compliance, the issuance and application of funds are critical to the financial operations of the Commonwealth. Any failure to appropriately allocate or use the funds as specified could lead to financial mismanagement or breach of statutory obligations, potentially resulting in legal or administrative repercussions. The seriousness of such breaches could lead to penalties, particularly if they result in financial loss or undermine the government's ability to meet its obligations for the year. The maximum penalties, if applicable, would be determined by other relevant legislation governing financial administration and appropriation.
