Overview

The Appropriation (No. 2) Act 1939-40 was enacted in response to the urgent financial needs of the Commonwealth of Australia during the early stages of World War II. The Act was passed by the Parliament of Australia to provide additional funding for the year ending 30 June 1940, specifically to support war services under the Department of Defence. Authorised by the King’s Most Excellent Majesty, the Senate, and the House of Representatives, the primary objective of this Act was to grant and apply an additional sum from the Consolidated Revenue Fund for the specified financial year. The Act came into operation immediately upon receiving Royal Assent, enabling the Treasurer to issue and apply the allocated funds towards the war effort as detailed in the Act’s schedule.

Scope and Application

The Appropriation Act (No. 2) 1939–40 applies to the Commonwealth of Australia and pertains to the allocation and application of the sum of Nine million pounds from the Consolidated Revenue Fund for the service of the year ending the thirtieth day of June One thousand nine hundred and forty. This Act authorises the Treasurer to issue and apply the specified sum for the purposes and services of the Department of Defence, as detailed in the Schedule to this Act. The Act comes into operation on the day it receives Royal Assent and applies to the financial year ending the thirtieth day of June One thousand nine hundred and forty. The appropriation covers various aspects of War Services (1939), including pay and allowances, camp expenses, general services, and arms, armament, ammunition, mechanization, machinery, plant, and equipment, all under the control of the Department of Defence. The application of this Act extends to all relevant departments and services within the Commonwealth, with the exception of business undertakings and territories of the Commonwealth.

Key Provisions

The Appropriation Act (No. 2) 1939–40 (section 1) is an Act that grants and applies an additional sum from the Consolidated Revenue Fund for the fiscal year ending 30 June 1940. The Act comes into operation on the day of Royal Assent (section 2). Under section 3, the Treasurer is authorised to issue and apply £9,000,000 from the Consolidated Revenue Fund to cover the supply granted to His Majesty for the service year ending 30 June 1940. This sum is to be used for the purposes and services detailed in the Schedule to this Act, which specifies the allocation for the Department of Defence, including war services for 1939. The total amount granted by this Act is appropriated for the purposes and services set out in the Schedule (section 4). The Act imposes several obligations on the parties it governs. The Treasurer, under section 3, must issue the specified sum from the Consolidated Revenue Fund and apply it strictly according to the allocations detailed in the Schedule. The funds must be used for the purposes and services set forth in the Act, particularly for the Department of Defence and its war services for 1939. These obligations ensure that the appropriated funds are used efficiently and effectively for the intended purposes, maintaining fiscal responsibility and transparency in the allocation and use of public funds. Breaches of the provisions of this Act could lead to serious consequences. While the Act does not explicitly list offences, penalties, or civil/criminal consequences, unauthorised use or misapplication of the appropriated funds could potentially lead to legal repercussions. Such actions might be construed as breaches of public trust, mismanagement of public funds, or violations of statutory financial obligations. Depending on the severity and context of the breach, consequences could include legal action, financial penalties, or other administrative sanctions imposed by relevant authorities. The precise penalties would depend on the specific nature of the breach and any additional legislative provisions or common law principles applicable in such cases.
