Overview

The Appropriation Act 1961-62 was enacted in 1961 to facilitate the appropriation of the financial supply granted by the Parliament for the fiscal year ending on 30 June 1962. This Act was passed by the Queen, the Senate, and the House of Representatives of the Commonwealth of Australia to ensure that the Consolidated Revenue Fund could be utilised for the government's services and expenditures for that financial year. The Act specifies the total amount of £735,657,000 that is appropriated for various government departments and services, business undertakings, and territories, as outlined in the schedules attached to the Act. The primary objective of this legislation is to provide a legal framework for the allocation and application of the approved financial supply towards the government’s operations and services.

Scope and Application

The Appropriation Act 1961-62 applies to the Commonwealth of Australia and governs the appropriation of funds from the Consolidated Revenue Fund for the financial year ending on the thirtieth day of June 1962. This Act allows the Treasurer to issue and apply a sum of Four hundred and fifty-nine million six hundred and eighty-seven thousand pounds towards the supply granted for that financial year. The total appropriation for the year, including sums from the Supply Act 1961-62, amounts to Seven hundred and thirty-five million six hundred and fifty-seven thousand pounds, which is designated for various government departments and services as detailed in the schedules. The Act applies to a broad range of government activities, including defence, health, and infrastructure, as well as specific territories and payments to states. The Act’s provisions are applicable nationally, covering all Commonwealth activities and entities. There are no exclusions, exemptions, or thresholds specified within the Act itself, though it may be subject to modifications through subordinate instruments.

Key Provisions

The Appropriation Act 1961-62 (sections 3 and 4) specifies that the Treasurer is authorised to issue £459,687,000 from the Consolidated Revenue Fund and that this sum, along with all sums granted by the Supply Act 1961-62 and this Act, amounting to £735,657,000 in total, is appropriated for the financial year ending 30 June 1962. This appropriation is deemed to have been effective from 1 July 1961. The Act details the allocation of funds across various departments and services as outlined in the Second Schedule, which includes expenditures for government operations, defence, and support for territories and states. The obligations imposed by the Act on the Treasurer and other relevant authorities include the precise allocation of funds as specified in the schedules. This involves ensuring that the appropriated funds are used strictly for the purposes outlined in the Second Schedule, which lists detailed expenditures for each department and service. The Act also mandates that any adjustments or additional appropriations must follow due legislative process. Breaches of the Act's provisions could result in both civil and criminal consequences. While the Act does not explicitly state penalties for non-compliance, it is understood that misuse or unauthorised use of the appropriated funds could lead to legal action under other relevant legislation. Penalties for such breaches could include fines or imprisonment, depending on the severity of the misconduct and the specific laws applicable. The exact penalties would be determined in the context of broader financial and administrative laws.
