Overview

The Appropriation Act 1960–61, enacted in 1960, was designed to address the need for the formal appropriation of funds by the Commonwealth of Australia for the financial year ending on 30 June 1961. This Act, passed by the Queen's Most Excellent Majesty, the Senate, and the House of Representatives, facilitates the issuing and application of funds from the Consolidated Revenue Fund. The primary purpose of this legislation is to authorise the Treasurer to issue and apply funds towards the supply granted for the specified financial year, ensuring that the appropriations are made for various governmental purposes as outlined in the Schedules. The policy objective is to provide a clear framework for the financial management and expenditure of the Commonwealth by legally appropriating the granted sums for designated services and purposes. The Appropriation Act 1960–61 outlines the total amount of £742,389,000 that was granted by Parliament for the financial year in question, detailing the allocation across various departments, services, and territories. This includes appropriations for departments such as Defence, Health, and Treasury, as well as for business undertakings like the Commonwealth Railways and the Postmaster-General’s Department. The Act ensures that the funds are appropriately allocated to meet the operational needs of the Commonwealth for the specified period.

Scope and Application

The Appropriation Act 1960–61 serves to allocate and authorise the expenditure of funds from the Consolidated Revenue Fund for the financial year ending on 30th June 1961. The Act applies to various government departments and services, business undertakings, and territories of the Commonwealth, as well as payments to the states. The funds are allocated in accordance with the Second Schedule, which lists the specific departments, services, and territories, along with the amounts appropriated for each. The Act applies nationally across the Commonwealth of Australia and comes into operation on the day it receives Royal Assent. The Act itself does not specify any exclusions, exemptions, or thresholds, but the appropriation of funds and their application are subject to other legislative and administrative provisions. The Act may be extended or restricted in application through subordinate instruments, which would need to be referenced in conjunction with the primary legislation.

Key Provisions

The Appropriation Act 1960–61 (sections 1–4) establishes the legal framework for the allocation and expenditure of government funds for the financial year ending on 30 June 1961. It specifies the total amount of £742,389,000 granted by the Parliament for the supply to be applied to various government departments, services, and entities. The Act allows the Treasurer to issue and apply funds from the Consolidated Revenue Fund as required for the year's supply. The appropriations are detailed in the Second Schedule, outlining the distribution of funds across different departments, services, and territories. The Act imposes specific obligations on the Treasurer and relevant government departments to ensure that the allocated funds are used strictly for the purposes outlined in the Second Schedule. Each department and service must account for their expenditures and ensure that they do not exceed the amounts specified in the Act. Additionally, the Act requires the Treasurer to manage the Consolidated Revenue Fund efficiently and ensure that all expenditures are within the approved budget and comply with the provisions of this Act. Failure to comply with the provisions of the Appropriation Act 1960–61 can result in significant consequences. While the Act does not explicitly outline specific offences or penalties for breaches, it is implicit that any misuse of funds or overspending would be subject to scrutiny and potential legal action. In cases of financial mismanagement or misappropriation of funds, individuals or entities responsible could face civil or criminal charges, including fines or imprisonment. The severity of penalties would depend on the extent of the breach and the impact on government finances.
