Overview

The Appropriation Act 1951-52, enacted in 1951, was established to allocate and apply funds from the Consolidated Revenue Fund for the financial year ending June 30, 1952. The Act, which received Royal Assent on December 5, 1951, authorises the Treasurer to issue and apply the specified sum of £212,716,000 to cover the supply granted to His Majesty. It also appropriates the total sum of £400,930,000, as detailed in the schedules, towards various departments and services for the financial year in question. The Act was enacted by the King's Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia, reflecting the collaborative legislative process required for financial appropriations in Australia. The policy objective of the Appropriation Act 1951-52 is to ensure that the government has the necessary financial resources to operate effectively and meet its obligations for the specified period. This includes funding for essential services and operations across various departments, as well as support for territories and business undertakings. The detailed allocation of funds is outlined in the schedules attached to the Act, which specify the amounts to be appropriated for different purposes.

Scope and Application

The Appropriation Act 1951-52 is an enactment by the Commonwealth of Australia that authorises the appropriation of funds from the Consolidated Revenue Fund for the financial year ending 30 June 1952. The Act applies to the Commonwealth government and its various departments and services, including those related to defence, civil aviation, health, and immigration, as well as business undertakings and territories. The Act has a national reach and applies to all entities and persons within the jurisdiction of the Commonwealth of Australia. The Act provides for the appropriation of a total sum of £400,930,000, with allocations specified for various departments and services as outlined in the Schedules to the Act. The Act also includes provisions for the issue and application of funds from the Consolidated Revenue Fund. The Act does not specify any exclusions, exemptions, or thresholds. The application of the Act may be extended or restricted through subordinate instruments, such as regulations or orders, which may provide further detail on the allocation and application of funds.

Key Provisions

The main operative sections of the Appropriation Act 1951-52 (sections 3 and 4) authorise the Treasurer to issue a specified sum from the Consolidated Revenue Fund and allocate the total supply granted for the financial year ending 30 June 1952. Section 3 allows the Treasurer to issue £212,716,000 from the Consolidated Revenue Fund to cover the supply granted for the financial year. Section 4 states that all sums granted by this and other specified Acts, totalling £400,930,000, are appropriated from 1 July 1951 for the purposes and services outlined in the Second Schedule. The Second Schedule details the allocation of funds to various departments and services, including Parliament, defence services, business undertakings, and territories of the Commonwealth. The Act imposes specific obligations and requirements on the Treasurer and relevant departments. The Treasurer must ensure the issued funds are applied strictly in accordance with the purposes and services specified in the Second Schedule. Each department and service listed in the Schedule must utilise the allocated funds for the stated purposes. For instance, the Department of External Affairs is allocated £1,568,000, and this sum must be used for foreign affairs activities. Similarly, the Department of Defence is allocated £181,703,000, which must be used for defence-related services. The Act also mandates that the funds must be applied for the financial year ending 30 June 1952, as specified. There are no explicit provisions within the Act detailing offences, penalties, or civil/criminal consequences for breaches of its provisions. However, breaches of appropriation acts typically result in legal consequences under general administrative law principles. If funds are misused or not applied according to the Act's provisions, it could lead to legal actions for misfeasance in public office or other related charges. The consequences could include financial penalties, recovery of misused funds, and potential criminal charges depending on the severity and intent behind the breach.
