Overview

The Public Service Act 1999 is a foundational piece of legislation in Australia designed to regulate the public service and provide a framework for the governance and management of public sector employees. This Act was introduced to address the need for a coherent and efficient public service structure that could effectively support the implementation of government policies and the delivery of services to the public. The Parliament of Australia enacted this Act to establish the legal basis for the public service, including the appointment, functions, and responsibilities of public service officers, as well as mechanisms for accountability and performance management. The policy objective of the Public Service Act 1999 is to ensure that the public service operates in a manner that is professional, accountable, and responsive to the needs of the community it serves. The Act thereby provides the legislative foundation for the appointment of key public service roles, such as the Secretary of the Department of Social Services, to facilitate effective governance and public service delivery.

Scope and Application

The Public Service Act 1999 provides the framework for the appointment of key officials within Commonwealth departments, including the Secretary of the Department of Social Services. This legislation applies to individuals who are appointed to public service positions, specifically targeting the high-ranking official roles within government departments. The Act ensures that such appointments are made in accordance with the provisions of the Act and any relevant regulations, thereby maintaining the integrity and efficiency of the public service. The appointment of Mr Raymond Griggs AO CSC as the Secretary of the Department of Social Services exemplifies the application of this Act, as it outlines the process and authority under which such a significant role is filled. The Act's jurisdictional reach is national, applying across all Commonwealth departments and public service roles, thereby ensuring consistency and adherence to federal standards and practices in the public sector. The Act does not specify exclusions, exemptions, or thresholds for appointments, leaving the interpretation and implementation to the relevant authorities.

Key Provisions

The Public Service Act 1999 (section 58(1)) provides the legal framework for the appointment of the Secretary of the Department of Social Services. Pursuant to this provision, Mr Raymond Griggs AO CSC has been appointed as the Secretary for a specified term of five years, starting from 22 July 2021. This appointment is made by the Governor-General of the Commonwealth of Australia, General the Honourable David Hurley AC DSC (Retd), acting on the advice of the Federal Executive Council. This legislative instrument formalises the appointment and sets the parameters for Mr Griggs' tenure. The Act imposes several obligations on the appointed Secretary, including the responsibility to manage the Department of Social Services in accordance with the law and policy directives issued by the government. The Secretary must ensure the efficient and effective administration of social services and compliance with relevant legislation and administrative guidelines. Additionally, the Secretary is required to report to the Minister for Social Services on the performance and activities of the department, ensuring transparency and accountability in the delivery of social services. Failure to comply with the requirements of the Public Service Act 1999 may result in disciplinary action, including potential removal from office. While the notifiable instrument itself does not detail specific penalties for non-compliance, breaches of the Act or related regulations could lead to civil or criminal proceedings. In cases of serious misconduct or breach of public trust, the Secretary could face legal consequences, which may include fines, imprisonment, or both, depending on the severity of the offence under applicable laws. The maximum penalties would be determined by the specific provisions of the law under which the offence is charged.
