Scope and Application

The Public Service Act 1999 applies to the governance and administration of public service positions within the Commonwealth of Australia. This Act specifically concerns the appointment of the Secretary of the Department of Agriculture, Water and the Environment, in this instance, Mr Andrew Metcalfe AO, for a fixed term of five years starting on 1 February 2020. The legislation delineates the scope of authority and responsibilities pertaining to the Secretary, ensuring that the role is fulfilled within the framework of public service legislation. The Act’s jurisdictional reach is confined to the Commonwealth, thereby governing federal public service appointments. There are no specific exclusions or exemptions mentioned within the scope of this particular notifiable instrument, and its application is direct without reliance on subordinate instruments for extension or restriction.

Key Provisions

The Public Service Act 1999 (section 58) facilitates the appointment of the Secretary of the Department of Agriculture, Water and the Environment, specifying the process and authority by which such appointments are made. In this instance, section 58(1) provides the Governor-General, acting on the advice of the Federal Executive Council, with the power to appoint the Secretary. The appointment of Mr Andrew Metcalfe AO, as evidenced by the instrument, outlines his role as Secretary for a specified term of five years, starting on 1 February 2020. This process ensures that the Secretary is appointed in a manner consistent with the legal framework established by the Act. The Act imposes specific obligations on the appointed Secretary, including adherence to the Public Service Act 1999, which governs the public service in Australia. The Secretary is required to carry out the functions of the department in accordance with the legislation, regulations, and any relevant policies. Additionally, the Secretary must ensure the efficient and effective administration of the department, including the management of its resources and personnel. These obligations are fundamental to maintaining the integrity and functionality of the public service and ensuring that departmental goals are achieved within the legal and policy frameworks established by the government. The Public Service Act 1999 also includes provisions that address the consequences of non-compliance or misconduct by the Secretary or any public servant. Breaches of the Act or regulations may result in disciplinary actions, including possible dismissal from service. Furthermore, serious misconduct or criminal activities can lead to civil or criminal proceedings. The specific penalties for breaches of the Act vary depending on the nature and severity of the offence, but they can include fines, imprisonment, or both. The Act ensures that there are clear repercussions for any failure to comply with its provisions, thereby upholding the standards expected of public servants.
