Overview
The Australian Electoral Commission Aboriginal and Torres Strait Islander Act 2005 was enacted to address the need for special electoral arrangements to ensure fair and accessible voting processes for Aboriginal and Torres Strait Islander peoples in elections and referenda. This Act was passed by the Australian Parliament with the policy objective of enabling and encouraging the participation of Aboriginal and Torres Strait Islander peoples in the electoral process, recognising their unique cultural and community needs. The Act empowers the Electoral Commissioner to make special provisions for voting in elections and referenda, including the appointment of polling places and mobile polling booths, to ensure that these provisions cater to the logistical and cultural requirements of Indigenous communities.
In exercising these powers, the Acting Electoral Commissioner, Jeff Pope, has declared specific locations as pre-polling voting offices, appointed a polling place, and designated certain hospitals as special hospitals for mobile polling booths for the 2019 Ugar Island ward by-election. This was done under the authority granted by the Torres Strait Regional Authority Election Rules 2017 and aims to facilitate the voting process for residents of the Torres Strait Islands, ensuring they have accessible and culturally appropriate opportunities to exercise their democratic rights.
Scope and Application
The Australian Electoral Commission, acting under the powers conferred by the Aboriginal and Torres Strait Islander Act 2005 and the Commonwealth Electoral Act 1918, appoints specific locations as polling places and pre-polling voting offices for the 2019 Ugar Island ward by-election in the Torres Strait Regional Authority. This appointment is made to ensure that eligible voters within the Torres Strait Islands have access to voting facilities, in compliance with the Torres Strait Regional Authority Election Rules 2017. The act applies directly to the specified polling places, pre-polling voting offices, and mobile polling booths listed in the schedules, which are strategically designated to serve the geographical and logistical needs of the electorate. The act's jurisdictional reach is limited to the Torres Strait Islands, a specific region within the Commonwealth of Australia, and the legislation ensures that the electoral process is accessible and convenient for Indigenous voters in this area. No exclusions, exemptions, or thresholds are explicitly mentioned in the text, but the focus is on practical implementation to facilitate voting in a remote and dispersed community.
Key Provisions
The primary operative sections of this legislation, as referenced, include sections of the Torres Strait Regional Authority Election Rules 2017. Section 53(2) allows for the declaration of pre-polling voting offices and the determination of their operational hours, as seen in Schedule 1. Section 74(2) facilitates the appointment of polling places and the setting of their operational hours, as detailed in Schedule 2. Section 77(1) permits the declaration of special hospitals to serve as mobile polling booths, with operational hours specified in Schedule 3. Finally, section 133(5) governs the appointment of a polling place, also outlined in Schedule 2. These sections collectively establish the framework for the by-election in the Ugar Island ward.
The obligations and requirements imposed by the Act on the parties and entities it governs are primarily administrative in nature. The Acting Electoral Commissioner is tasked with declaring specific locations as pre-polling voting offices, special hospitals as mobile polling booths, and a polling place, all with clearly defined operational hours. These declarations are made under the authority granted by the Torres Strait Regional Authority Election Rules 2017 and the Aboriginal and Torres Strait Islander Act 2005. The Commissioner must ensure that these locations are operational on the specified dates and times to facilitate the by-election process.
The Torres Strait Regional Authority Election Rules 2017, alongside the Australian Electoral Act 1918, establish the legal framework within which these declarations must be made. Any failure to comply with these rules or the provisions of the Act could potentially lead to civil or criminal consequences. For instance, if the declared polling places and times are not properly adhered to, it could result in disenfranchisement of voters or other procedural issues that might need to be addressed through the courts. While specific penalties are not detailed in this excerpt, breaches of electoral laws can typically result in fines or other legal repercussions as prescribed by the relevant legislation.
