Overview

The Industry Research and Development Act 1986 was enacted by the Commonwealth Parliament to establish a framework for promoting and funding industry research, development, and innovation in Australia. The Act aims to foster economic growth and competitiveness by supporting research activities that contribute to the advancement of industries. One of the mechanisms introduced under the Act is the appointment of specialised committees to oversee specific areas of investment. This approach ensures targeted support for critical sectors, such as clean technology and food and foundries industries, aligning with the overarching policy objective of enhancing Australia’s technological capabilities and economic resilience. Effective from 25 September 2012, the Minister for Industry and Innovation, Gregory Ivan Combet, appointed a Clean Technology Food and Foundries Investment Committee to assist Innovation Australia in exercising its powers and functions under the Act. This committee is intended to provide expert guidance and oversight to ensure that investments are directed towards areas that will yield significant economic and technological benefits.

Scope and Application

The Industry Research and Development Act 1986 applies to entities and persons involved in research and development activities within Australia, particularly those seeking financial assistance for innovation projects. The Act provides a legislative framework for the establishment of investment committees, such as the Clean Technology Food and Foundries Investment Committee, to facilitate and oversee funding decisions aligned with national priorities in specific industries. This committee's jurisdiction is confined to the Commonwealth level, thereby impacting entities and projects across Australia that align with the Act's outlined objectives. The Act does not specify exclusions or thresholds for eligibility; however, it operates through subordinate instruments such as Directions made under sections 18, 19, and 20, which detail specific criteria and conditions for funding allocations. This legislative structure ensures that the investment committee's actions are consistent with broader policy directives aimed at fostering technological advancement and economic growth in targeted sectors.

Key Provisions

The Industry Research and Development Act 1986 (the Act) has been amended to include provisions for the appointment of a Clean Technology Food and Foundries Investment Committee. Section 22(1) of the Act allows the Minister for Industry and Innovation to appoint such a committee, which, in this instance, has been established to assist Innovation Australia (the Board) in exercising its powers and functions as conferred under sections 18, 19, and 20 of the Act. This amendment aims to provide targeted support and investment in clean technology and food and foundries sectors, ensuring that innovation and research efforts are directed towards these critical areas. The Clean Technology Food and Foundries Investment Committee is tasked with advising Innovation Australia on matters related to clean technology and food and foundries investments. This includes assessing the merits of proposed investments, providing recommendations on funding priorities, and ensuring that the Board’s efforts are aligned with national innovation and sustainability goals. The committee's role is pivotal in guiding the Board's decision-making process, ensuring that resources are allocated effectively to projects that promise significant advancements in clean technology and food production efficiency. Under the Act, the committee is expected to operate with due diligence, transparency, and accountability. It must adhere to the guidelines and directives issued by Innovation Australia and report its findings and recommendations to the Board. The committee is also required to maintain records of its meetings, decisions, and the basis for its recommendations, ensuring that all processes are well-documented and justifiable. These obligations ensure that the committee's activities are in line with the objectives of the Act and support the broader goals of promoting innovation and economic growth. Breach of the obligations set out in the Act can lead to various consequences. The committee members may be subject to disciplinary actions if they fail to meet their duties, which could include removal from their positions. Additionally, any failure to comply with the reporting requirements or guidelines could result in legal scrutiny or investigations. While specific penalties for breaches are not detailed in the text, the general principle is that non-compliance with legislative directives can lead to civil or criminal sanctions, depending on the severity and intent behind the breach. These could potentially include fines or other penalties as determined by relevant authorities.
