Overview
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to regulate the exploration, production, storage, and transportation of offshore petroleum and greenhouse gas. This legislation was introduced to address the need for a comprehensive regulatory framework governing offshore petroleum activities and greenhouse gas storage operations in Australia. The Act provides a legal basis for the administration of offshore petroleum titles, the regulation of activities associated with these resources, and the mitigation of environmental impacts. Enacted by the Commonwealth Parliament, the policy objective of the Act is to ensure the safe and environmentally responsible development of offshore petroleum resources while facilitating economic benefits for Australia.
In the context of the application for the variation of Pipeline Licence WA-29-PL, the Act provides the necessary legislative framework to manage and regulate the proposed changes to the pipeline route and its design and construction. This application, submitted by Woodside Energy Julimar Pty Ltd and KUFPEC Australia (Julimar) Pty Ltd, is subject to public scrutiny and review, ensuring transparency and accountability in the decision-making process. The Act allows for written submissions from interested parties within a specified timeframe, enabling stakeholders to voice their concerns and contribute to the regulatory process.
Scope and Application
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to the conduct of entities involved in offshore petroleum activities and greenhouse gas storage operations within Australian waters. This Act governs the regulation of offshore petroleum titles, pipeline licences, and greenhouse gas storage operations, encompassing both exploration and production phases. It applies to entities such as Woodside Energy Julimar Pty Ltd and KUFPEC Australia (Julimar) Pty Ltd, which are seeking variations to their pipeline licences. The Act extends to the Commonwealth and state waters of Australia, specifically in this instance, the offshore area of Western Australia. The application of the Act is further detailed through subordinate instruments and guidelines, ensuring comprehensive oversight and regulation of activities related to offshore petroleum and greenhouse gas storage. The Act does not specify exclusions or exemptions directly in this notice, but such details would typically be found in the main body of the Act or in related regulations and guidelines.
Key Provisions
Sections 226 and 708 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the "Act") govern the procedure for an application for the variation of a pipeline licence in offshore areas. Under section 226, the National Offshore Petroleum Titles Administrator, on behalf of the Commonwealth–Western Australia Offshore Petroleum Joint Authority, must notify the public of an application for a pipeline licence variation. The notice must be published in the Australian Government Gazette and specify the details of the application. Section 708 allows for public submissions within 30 days of the notice being published.
The obligations and requirements imposed by the Act on the parties involved include ensuring that the offshore pipeline is designed and constructed according to the specified standards. Specifically, the pipeline must comply with Offshore Standard DNVGL‐ST‐F101 ‐ Submarine Pipeline Systems, as incorporated in Australian Standard AS2885.4 ‐ Pipelines, Gas and Liquid Petroleum (Part 4: Submarine Pipelines). The design and construction phase must adhere to this standard, which includes specific details such as the steel grade, operating design pressure, and cathodic protection measures. The pipeline must be installed within an 80 m corridor, with coordinates based on the Geodetic Datum of Australia (GDA94), starting at the Julimar-A Manifold and ending at the Brunello-A Crossover Manifold.
Failure to comply with the requirements set out in the Act may result in various consequences. While the specific penalties are not detailed in the provided text, the Act generally allows for enforcement actions, including fines and potential criminal charges, for non-compliance with its provisions. The penalties can vary depending on the severity of the breach and the specific provisions that have been violated. Public entities and companies involved in offshore petroleum activities must ensure strict adherence to the Act's requirements to avoid any legal repercussions.
