Attachment A

Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to provide a comprehensive legal framework for the regulation of offshore petroleum activities and greenhouse gas storage in Australia. This Act addresses the need for a unified and efficient system to manage the exploration, production, and storage of offshore petroleum resources, while also considering environmental protection and the mitigation of greenhouse gas emissions. Enacted by the Commonwealth Parliament, the Act aims to ensure that offshore activities are conducted in a manner that balances economic interests with environmental sustainability and public safety. The Act establishes the legal basis for licensing, environmental protection, and safety standards, providing a structured approach to the regulation of offshore operations. The Commonwealth of Australia, through the enactment of this Act, seeks to achieve policy objectives such as promoting the responsible development of offshore petroleum resources, protecting the marine environment, and ensuring the safety and reliability of offshore infrastructure. The Act empowers the relevant authorities to issue licenses, impose conditions, and enforce compliance with safety and environmental standards. This legislative framework is designed to foster responsible and sustainable practices in the offshore petroleum industry, thereby contributing to both economic growth and environmental stewardship.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to the regulation and management of offshore petroleum activities and greenhouse gas storage within Australian waters. Specifically, this Act governs the granting and variation of pipeline licences, such as Pipeline Licence VIC/PL26, which is pertinent to the offshore area of Victoria. The Act applies to entities involved in offshore petroleum activities, including companies like Esso Australia Resources Pty Ltd and Woodside Energy (Bass Strait) Pty Ltd, who are seeking variations to their pipeline licences. The geographic reach of this Act is limited to Commonwealth waters, including state offshore areas such as Victoria. The Act also outlines procedures for public submissions on licence variations, as indicated in the notice, allowing interested parties to comment within a specified period. Additionally, the Act may extend or restrict its application through subordinate instruments, which may provide further detail on technical standards and operational requirements. However, the notice does not explicitly mention any exclusions, exemptions, or thresholds applicable to this specific variation application.

Key Provisions

Pursuant to sections 226 and 708 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006, Steven Robert Taylor, acting as the Delegate of the National Offshore Petroleum Titles Administrator, provides notice of an application by Esso Australia Resources Pty Ltd and Woodside Energy (Bass Strait) Pty Ltd to vary Pipeline Licence VIC/PL26. The application proposes significant changes to the pipeline's route and operational parameters. Specifically, the First Schedule (Route of the Pipeline) will be amended to detail a new pipeline route from the Bream B platform to the Bream A platform, with precise coordinates provided for various inflection points and critical junctions. Additionally, the Second Schedule, which details design, materials, protective coatings, and cathodic protection, will be altered by removing specific riser design parameters, materials specifications, coating requirements, and cathodic protection methods. The application imposes obligations on Esso Australia Resources Pty Ltd and Woodside Energy (Bass Strait) Pty Ltd to provide detailed plans and specifications for the proposed pipeline route and modifications. They must ensure that all changes comply with relevant safety and environmental standards, and must submit these to the Titles Administrator for review. Furthermore, the companies must address any feedback from the Titles Administrator and the public during the submission period. The application also requires the companies to submit any additional documentation or information necessary to support their proposal for the pipeline variation. Under the Act, failure to comply with the requirements for pipeline licence variations may result in penalties or other enforcement actions. Any breaches of the legislative provisions regarding the operation and management of offshore petroleum activities can lead to civil or criminal penalties. The maximum penalties for serious offences under the Act can include substantial fines and, in some cases, imprisonment for individuals. For companies, the penalties can include fines that are significant, reflecting the severity of the breach and its impact on safety and the environment. The Act also allows for the suspension or revocation of licences in cases of serious non-compliance or repeated offences.
