Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted by the Parliament of Australia to address the need for a comprehensive legal framework governing offshore petroleum activities and greenhouse gas storage in Australia. This legislation aimed to provide a consistent and coordinated approach to the regulation of offshore petroleum and greenhouse gas storage activities, ensuring environmental protection, safety, and efficient management of resources. The Act establishes a regulatory regime overseen by the National Offshore Petroleum Titles Administrator, who is responsible for administering the licensing and regulatory framework. The policy objective of the Act is to facilitate the exploration, development, and production of offshore petroleum resources while ensuring that activities are conducted in a manner that safeguards the environment and promotes sustainable practices.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to the offshore petroleum and greenhouse gas storage activities within the Commonwealth of Australia, including the state of Victoria. This particular application for the variation of Pipeline Licence VIC/PL14 pertains to Esso Australia Resources Pty Ltd and Woodside Energy (Bass Strait) Pty Ltd. The Act governs the licensing and operations of offshore petroleum and greenhouse gas storage activities, and variations to the pipeline licence must comply with its provisions. The notice allows for written submissions from interested parties within 30 days, highlighting the transparency and public participation aspect of the Act. The Act’s application is not limited to the Commonwealth but extends to state-specific offshore areas, as demonstrated by this case in Victoria. Any exclusions or exemptions from the Act’s application would need to be specified in the subordinate legislation or specific licence terms. The Act may also extend or restrict its application through regulations, which provide further detail on the management and control of offshore activities.

Key Provisions

Sections 226 and 708 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the Act) require the Titles Administrator to provide public notice of an application for the variation of a pipeline licence. In this instance, the application for the variation of Pipeline Licence VIC/PL14 is made by Esso Australia Resources Pty Ltd and Woodside Energy (Bass Strait) Pty Ltd. The notice specifies that the application seeks to amend the route descriptions of the redundant and remaining DN300 pipelines, as well as the materials of construction and protective coating of the riser pipework. This amendment follows the completion of repair and decommissioning activities at specified locations. The Act imposes specific obligations on the parties involved in the application for variation of the pipeline licence. These obligations include the submission of a detailed application that specifies the changes to the pipeline route and the materials of construction, as well as the provision of technical and operational details necessary for the assessment of the application. Additionally, the parties must ensure that the proposed changes comply with all relevant safety, environmental, and technical standards. The Titles Administrator must also consider any written submissions from the public within the stipulated 30-day period. Failure to comply with the provisions of the Act can lead to various civil and criminal consequences. Under the Act, any person who contravenes a provision can be subject to penalties, including fines up to a maximum of $1.1 million for corporations and $220,000 for individuals, as stipulated in section 829 of the Act. Additionally, the Act empowers the court to order the cessation of activities that breach the Act’s provisions, and in severe cases, criminal charges may be laid against individuals responsible for the breach. These stringent measures underscore the importance of adhering to the regulatory framework governing offshore petroleum activities in Australia.
