By Authority: L. F. Johnston, Commonwealth Government Printer, Canberra.

Overview

The Apple and Pear Organization (Staff) Regulations, made in 1953 under the authority of the Governor-General, provide a framework for the employment of staff for the Australian Apple and Pear Board. Enacted by the Parliament of Australia, these regulations address the need for specific guidelines governing the salaries, employment conditions, and other administrative details of the Board’s staff. The policy objective is to ensure that the Board’s staff are compensated and managed in a manner consistent with the broader public service standards while allowing for flexibility to accommodate the unique needs of the apple and pear industry. The regulations specify salary scales, employment conditions, and allowances, ensuring that the Board’s operations are efficient and well-regulated.

Scope and Application

The Apple and Pear Organization (Staff) Regulations, established under the Apple and Pear Organization Act 1938-1948, pertain to officers appointed under section 12 of that Act. These Regulations detail the terms and conditions of employment for officers, including their salaries and increments, which are specified in the Second Schedule. The scope of these Regulations is limited to officers who are employed by the Australian Apple and Pear Board, and they include provisions for leave, holidays, attendance, performance of duties, hours of duty, overtime payments, and allowances. Furthermore, the Regulations outline the entertainment expenses that may be reimbursed to officers, subject to a cap of Two hundred pounds per twelve-month period unless approved by the Minister. For officers stationed in the United Kingdom, these Regulations stipulate that their employment terms and conditions are governed by the High Commissioner (Staff) Regulations. The Regulations came into effect on 1 July 1949, and repealed previous statutory rules as detailed in the First Schedule.

Key Provisions

The Apple and Pear Organization (Staff) Regulations (Regulations) set out the terms and conditions of employment for officers appointed under the Apple and Pear Organization Act 1938-1948, as well as their salaries and entitlements. Officers are defined in section 4 as those appointed under section 12 of the Act. The Regulations specify the annual salaries and increments for different offices as outlined in the Second Schedule, which is attached to the Regulations. Officers are required to be employed under the same conditions with respect to leave, holidays, attendance, performance of duties, hours of duty, overtime payment, and allowances as those prescribed in the Commonwealth Public Service Act 1922-1948 or the Commonwealth Public Service Regulations. Where the functions and duties of an officer are substantially similar to those of an officer in relation to whom a determination has been made under the Arbitration (Public Service) Act 1920-1947, the officer shall be employed under the same conditions with respect to that matter as are prescribed by the determination. The Chairman of the Australian Apple and Pear Board is authorised to make available up to Two hundred pounds in any twelve-month period for entertainment expenses incurred by officers, subject to the approval of the Minister. Officers appointed and employed in the United Kingdom shall be paid at the rates and employed under the conditions prescribed by the High Commissioner (Staff) Regulations. There are no explicit provisions within the Regulations that outline offences, penalties, or civil or criminal consequences for breach. However, non-compliance with the terms and conditions of employment, salary entitlements, or other provisions may lead to disputes or grievances that could be addressed through relevant industrial or employment law mechanisms. It is important for officers and the Board to ensure adherence to the Regulations to avoid potential legal issues.
