Overview

The Apple and Pear Organization Regulations 1942 were introduced as a legislative instrument under the Apple and Pear Organization Act 1938. This legislation was enacted by the Commonwealth Parliament to manage and regulate the apple and pear industries within Australia, aiming to address issues such as the stability of supply, market prices, and the overall economic well-being of the industry. The 1942 regulations specifically sought to adjust salaries in accordance with variations in the cost of living, as reflected by changes in the weighted average retail price index numbers for the six state capital cities of Australia. The policy objective was to ensure that the salaries of industry officers remained aligned with economic conditions, thereby maintaining fairness and stability within the industry.

Scope and Application

The Apple and Pear Organization Regulations, made under the Apple and Pear Organization Act 1938, apply to officers employed by the Commonwealth of Australia in roles related to the apple and pear industry. The regulations specifically address adjustments to salaries based on variations in the cost of living, using the weighted average retail price index number for the six state capital cities. The adjustments apply to adult males, adult females, and officers under 21 years of age, with different rates of salary increase or decrease depending on the index number. The regulations have a national reach within the Commonwealth of Australia and commence on the first day of May, 1942. The Minister has the discretion to direct otherwise in specific cases, but the regulations provide a structured approach to salary adjustments in response to changes in the cost of living. The application of the regulations can be extended or restricted through subordinate instruments, which are not specified in this particular legislative instrument.

Key Provisions

The Apple and Pear Organization Regulations, amended by Statutory Rules 1942, No. 534, introduce a mechanism for adjusting the salaries of officers under the Apple and Pear Organization Act 1938 based on changes in the cost of living. Regulation 11a specifies how salaries are to be varied depending on the weighted average retail price index number for the six state capital cities, published by the Commonwealth Court of Conciliation and Arbitration. If the index number falls below 81.7, salaries are reduced according to a specified table correlating index number ranges to specific reductions (section 11a(2)). Conversely, if the index number exceeds 83.9, salaries are increased, again according to a table correlating index number ranges to specific increases (section 11a(4)). If the index number falls below 67.9 or rises above 97.7, further reductions or increases are applied for each 2.3-point deviation from the threshold, respectively (sections 11a(3) and 11a(5)). Additionally, fixed annual increments are added to salaries regardless of the index number (section 11a(6)). The Regulations impose specific obligations on the relevant parties, including the calculation and adjustment of salaries in accordance with the specified index number thresholds and corresponding reductions or increases. The Minister has the authority to direct otherwise for individual officers (section 11a(2) and 11a(4)). The Regulations also require that the first adjustment be made based on the index number for the six months ending on 30 March 1941, deemed to be 80.2 (section 11a(8)). The adjustments must be implemented from the commencement of the first fortnightly pay period after the regulation's commencement (section 11a(7)). Failure to comply with the requirements of these Regulations could lead to administrative or legal consequences. Although the specific penalties for non-compliance are not detailed in the provided text, breaches of regulations typically result in administrative penalties, including fines, or other corrective actions as deemed necessary by the relevant authorities. The severity of penalties may vary based on the nature and extent of the non-compliance.
