Overview

The Apple and Pear Organization Regulations 1951 were enacted under the Apple and Pear Organization Act 1938–1948 to provide for the regulation of the export of apples and pears from Australia. This legislative instrument was created by the Administrator of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, to amend the existing Apple and Pear Organization (Licences and Permits) Regulations. The primary policy objective of these regulations is to ensure that the export of apples and pears is conducted in a manner that is beneficial to the apple and pear export trade of the Commonwealth. This is achieved through the establishment of specific requirements and conditions for the issuance of export licences and permits, as well as the imposition of restrictions on the sale and export of apples and pears overseas.

Scope and Application

The Apple and Pear Organization Regulations, made under the Apple and Pear Organization Act 1938–1948, govern the export of apples and pears from the Commonwealth of Australia. The Act applies to individuals and entities seeking to export apples and pears, including those who need to obtain a licence or permit from the Australian Apple and Pear Board. The Regulations detail the process for applying for and obtaining these licences and permits, including the forms to be used and the information required. The geographic reach of the Act is national, as it pertains to exports from any port within Australia to specified international destinations. The Regulations impose several conditions and restrictions on licensees, including limits on the price at which apples and pears can be sold overseas and the requirement to obtain a permit for exports. There are no stated exclusions or exemptions in the Regulations themselves, although the scope of the Act may be further defined through subordinate instruments. The Regulations provide the Board with the authority to determine the specific ports from which and to which exports may be made, taking into account factors such as the exporter's experience, available facilities, and the welfare of the apple and pear export trade.

Key Provisions

The Apple and Pear Organization (Licences and Permits) Regulations, as amended, establish a framework for the licensing and permitting processes for the export of apples and pears from Australia. These regulations, detailed under sections 1 to 7 and the Schedule, set out the requirements for the application and issuance of export licences and permits, as well as the conditions and restrictions that apply to these activities. Firstly, section 1 amends the interpretation clause to clarify that references to forms in the Regulations refer to the forms outlined in the Schedule, and that references to apples or pears can include either fruit or both. Section 2 introduces a new regulation (4a) specifying that applications for export licences must be made in accordance with Form A, which includes details of the applicant and the intended export ports. Licences themselves, governed by section 2(2), are to be issued in accordance with Form B and are valid for a period determined by the Board. Section 2(3) allows a licensee to hold more than one licence. Secondly, section 3 modifies the permit application process, stipulating that applications must adhere to Form C and can be submitted to the Secretary or an authorized person. Permits, detailed in section 3(2), must be in accordance with Form D. Section 4 introduces new conditions and restrictions for licensees, such as the requirement to provide export return information, and prohibits selling or exporting apples or pears at prices below those authorized by the Board, as well as entering into contracts or agreements that facilitate such sales. It also imposes restrictions on exporting to destinations other than specified regions unless certain conditions are met. Section 4 further allows the Board to determine the ports from which and to which apples and pears may be exported, subject to certain criteria. The obligations imposed by these regulations include the submission of detailed applications for licences and permits, adherence to specified forms, and compliance with conditions and restrictions such as authorized pricing and permitted export ports. The Board has the authority to determine these conditions and restrictions based on factors such as the licensee's experience, available facilities, and the welfare of the apple and pear export trade. Finally, any breaches of these regulations may result in penalties or other legal consequences. While the specific penalties are not detailed in the legislative instrument, under the Apple and Pear Organization Act 1938-1948, offences related to non-compliance with licensing and permitting requirements could potentially lead to fines or other civil or criminal penalties as prescribed by relevant laws. The exact nature and severity of these penalties would depend on the specific breach and the applicable legal provisions.
