Overview

The Statutory Rules 1953 No. 26, enacted under the authority of the Governor-General, address the need to update the Apple and Pear Organization (Fees and Expenses) Regulations 1938-1948. This legislative instrument was created to modernise the allowances for travelling expenses of members who attend meetings or engage in business for the Board or the Executive Committee of the Board. The policy objective behind these amendments is to ensure that the compensation for such expenses is fair and reflective of the actual costs incurred by the members, thereby encouraging active participation in the organisation's activities. This amendment was made with the advice of the Federal Executive Council and was notified in the Commonwealth Gazette on 9 April 1953.

Scope and Application

The Apple and Pear Organization (Fees and Expenses) Regulations 1953, made under the Apple and Pear Organization Act 1938-1948, apply to members of the Board or the Executive Committee of the Board involved in the apple and pear industry. The Act pertains specifically to those members who are required to travel for meetings or to conduct business on behalf of the Board. The regulations cover the allowances for travelling expenses that these members are entitled to receive, either a fixed allowance or the actual expenses incurred, depending on which is greater. The scope of the Act is limited to the apple and pear industry within the Commonwealth of Australia, and its application is restricted to the specified allowances for travelling expenses related to the Board's activities. The regulations themselves were deemed to have come into operation on the first day of July 1952, and any amendments to the original regulations, as detailed in the Statutory Rules, extend the application of the Act to include the updated allowances from that date.

Key Provisions

The primary operative section of these Regulations, section 1, pertains to the amendment of Regulation 7 within the Apple and Pear Organization (Fees and Expenses) Regulations. Specifically, sub-regulation (1.) is altered to provide a new allowance for members who must travel for meetings of the Board or Executive Committee, or for other business as determined by the Board. Members can now claim either a flat allowance of Three pounds three shillings per day for travel expenses or, if the flat rate is insufficient, the actual travel expenses incurred (section 1(1)). This amendment came into effect on 1 July 1952, as stipulated in section 2. Under these Regulations, members who are required to travel for Board or Executive Committee meetings, or for other business as decided by the Board, are entitled to claim reimbursement for their travel expenses. The claim can be for either a daily allowance of Three pounds three shillings or, if the allowance is not sufficient to cover the expenses, the actual amount incurred. This ensures that members are adequately compensated for their travel costs, which is a critical aspect of their duties under the Apple and Pear Organization Act 1938-1948. There are no explicit provisions in these Regulations detailing offences, penalties, or consequences for non-compliance. However, under the overarching Act, failure to comply with the regulations could potentially lead to legal consequences. This might include disciplinary actions, fines, or other sanctions as determined by the governing body of the Apple and Pear Organization. The specific penalties would be in accordance with the broader legal framework established by the Apple and Pear Organization Act 1938-1948, but the Regulations themselves do not specify these penalties.
