Overview
The Apple and Pear Organization (Banking) Regulations 1961 were enacted to provide specific guidelines for the banking activities of the Australian Apple and Pear Board, under the authority of the Apple and Pear Organization Act 1938-1960. This legislative instrument was created to ensure that financial transactions involving the Board were conducted with proper oversight and accountability. The regulations were made by the Administrator of the Government of the Commonwealth of Australia, with the advice of the Federal Executive Council, and came into effect on 14 April 1961. These regulations replaced the previous Apple and Pear Organization (Banking) Regulations from 1949, thereby updating the legal framework to better suit the evolving needs of the apple and pear industry. The primary policy objective of these regulations was to enhance the financial management and integrity of the Australian Apple and Pear Board, ensuring that cheques drawn on specified accounts were signed by authorised individuals, including members of the Board and designated representatives.
Scope and Application
The Apple and Pear Organization (Banking) Regulations, made under the authority of the Apple and Pear Organization Act 1938-1960, govern the signing of cheques for accounts associated with the Australian Apple and Pear Board. These Regulations apply specifically to cheques drawn on accounts as outlined in section 20(1) of the Act, which likely pertains to accounts related to the financial activities of the Australian Apple and Pear Board. The Regulations dictate that cheques must be signed by a member of the Australian Apple and Pear Board and either by another member of the Board or by the Secretary to the Board. In cases where the account is maintained in London, cheques must be signed by the Overseas Representative in London of the Australian Apple and Pear Board or by the Agricultural Representative in London of the Department of Primary Industry. This ensures that there is appropriate oversight and authorisation for financial transactions conducted through these accounts. The Regulations also repeal the previous Apple and Pear Organization (Banking) Regulations, which were published in 1949, thus updating the legal framework governing the signing of cheques for the Board’s accounts.
Key Provisions
The Apple and Pear Organization (Banking) Regulations, established under the Apple and Pear Organization Act 1938-1960, set out specific provisions regarding the signing of cheques for certain accounts. According to Regulation 3(1), a cheque drawn on an account specified in sub-section (1) of section 20 of the Act must be signed by a member of the Australian Apple and Pear Board and either by another member of the Board or by the Secretary to the Board. Regulation 3(2) further specifies that for accounts maintained in London, cheques must be signed either by the Overseas Representative in London of the Australian Apple and Pear Board or by the Agricultural Representative in London of the Department of Primary Industry.
These Regulations impose clear obligations on the Australian Apple and Pear Board and relevant representatives to ensure proper authorisation and signing of cheques. Members of the Board and their designated representatives must adhere strictly to the signing requirements outlined in the Regulations to maintain the integrity and legality of financial transactions. The regulations aim to provide a framework that ensures accountability and oversight in the financial activities of the Board.
Failure to comply with the signing requirements as stipulated in the Regulations may result in various consequences. While the specific penalties are not detailed in the Regulations themselves, non-compliance could potentially lead to civil or criminal liabilities under the Apple and Pear Organization Act 1938-1960. This could include financial penalties, legal action, or other sanctions as deemed appropriate under the governing legislation. The precise nature and extent of the penalties would depend on the specific circumstances of the breach and any applicable laws.
