CHAIRMAN

Overview

The Veterans’ Entitlements Act 1986 is a pivotal piece of Australian legislation that provides a framework for the entitlement of benefits and services to veterans and their families. Enacted by the Australian Parliament, the Act aims to address the needs of veterans who have served in the Australian Defence Force and their dependents, ensuring they receive appropriate support and care. This legislative instrument, F2005B03742, specifically targets the Statement of Principles concerning Trigeminal Neuralgia under the Act. It was introduced to address the need for an updated and precise definition of medical conditions relevant to veterans' claims, particularly by removing outdated or ambiguous references to certain conditions, such as "diabetes mellitus". The policy objective of this amendment is to ensure that the Statement of Principles accurately reflects current medical understanding and terminology, thereby facilitating clearer and more effective processing of veterans' claims. The Repatriation Medical Authority, acting under the authority conferred by the Act, made this amendment to ensure the legislative framework remains relevant and effective in serving the needs of veterans.

Scope and Application

The Legislative Instrument No.11 of 2002, an amendment to the Statement of Principles concerning Trigeminal Neuralgia ICD Code: 350.8, made under the Veterans' Entitlements Act 1986, pertains to the revision of the medical principles related to veterans' claims for trigeminal neuropathy. This amendment, executed by the Repatriation Medical Authority, specifically modifies Instrument No.81 of 1995 by removing the definition of "diabetes mellitus" from paragraph 4. This change extends to all matters to which Instrument No.81 of 1995 and section 120A of the Act apply, impacting the scope of medical conditions and entitlements for veterans seeking compensation. The amendment does not alter the geographic or jurisdictional reach of the Act, which remains within the Commonwealth framework, and does not introduce new exclusions or exemptions beyond the specific modification of the diabetes mellitus definition. The instrument is effective as of its issuance and does not rely on subordinate instruments for further extension or restriction of its application.

Key Provisions

The main operative sections of this legislative instrument, specifically Instrument No.11 of 2002, involve the amendment of Statement of Principles concerning Trigeminal Neuropathy, which falls under the ICD code 350.8 as per the Veterans’ Entitlements Act 1986. This amendment is executed by the Repatriation Medical Authority under subsection 196B(2) of the Veterans’ Entitlements Act 1986. The primary change is the deletion of the definition of "diabetes mellitus" from paragraph 4 of Instrument No.81 of 1995. This alteration is intended to refine the scope and application of the legislative principles governing trigeminal neuropathy and its recognition under the Act. The obligations imposed by this legislation primarily focus on ensuring the accurate and updated application of medical principles and definitions in the assessment and recognition of trigeminal neuropathy in veterans. By removing the specific definition of "diabetes mellitus" from the previous instrument, the Act seeks to streamline and clarify the criteria used in evaluating claims related to trigeminal neuropathy. This amendment ensures that the medical authority can apply the most current and relevant standards in its assessments, thereby providing more precise and consistent outcomes for veterans seeking entitlements. In terms of potential consequences for breach or non-compliance, the legislative instrument itself does not explicitly detail specific offences, penalties, or civil/criminal consequences. However, the Veterans’ Entitlements Act 1986, under which this amendment operates, does provide a framework for addressing non-compliance with its provisions. Generally, breaches of the Act may lead to administrative penalties, legal actions, or other corrective measures as deemed appropriate by the relevant authorities. The precise penalties would depend on the nature and severity of the breach, as well as the specific provisions of the Act that are contravened. Nevertheless, the overarching aim of this amendment is to enhance the clarity and fairness of the legislative process concerning veterans' entitlements.
