Overview

The Environment Protection and Biodiversity Conservation Act 1999 (the Act) is a key piece of Australian legislation designed to protect the nation's environment and biodiversity. Enacted by the Australian Parliament, the Act aims to provide for the protection of the environment, particularly its biodiversity, by regulating activities that may have a significant impact on the environment. One of its key functions is to manage the trade and movement of native specimens to ensure that it does not adversely affect the conservation and sustainable use of native species. The legislative instrument F2005B02229 amends the list of exempt native specimens under the Act, specifically including specimens derived from fish or invertebrates taken in the Onslow Prawn Managed Fishery and the Nickol Bay Prawn Managed Fishery, subject to certain conditions. This amendment was made to address the need for specific regulatory measures to ensure that the management of these fisheries does not negatively impact the conservation of native species, while still allowing for sustainable fishing practices.

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999, as amended, applies to a wide range of activities that may impact the environment and biodiversity across Australia. This legislation serves to protect native flora and fauna, including endangered species, ecological communities, and heritage places of national significance. The Act applies to individuals, companies, government entities, and other organisations engaging in activities that may impact the environment. Its jurisdictional reach is national, covering all of Australia, including Commonwealth waters, territories, and state waters up to three nautical miles from the coast. The Act includes mechanisms for extending its application through subordinate instruments, such as regulations and codes of practice, which may provide additional detail or specify particular circumstances under which the Act applies. In this particular amendment, specimens derived from fish or invertebrates taken in specified prawn fisheries in Western Australia are added to the list of exempt native specimens, subject to certain conditions including lawful taking and a temporal restriction until 18 November 2009.

Key Provisions

The legislative instrument amends the Environment Protection and Biodiversity Conservation Act 1999 by updating the list of exempt native specimens (section 303DB). Specifically, it includes specimens derived from fish or invertebrates taken within the Onslow Prawn Managed Fishery and the Nickol Bay Prawn Managed Fishery, provided they are not from species listed under Part 13 of the Act (sections 303DC(1)). This amendment ensures that such specimens are exempt from certain provisions of the Act, but only under specific conditions. The Act imposes several obligations and requirements on parties involved with these specimens. Firstly, the specimens must be taken lawfully, meaning they must adhere to all relevant fishing regulations and management plans outlined in the Onslow Prawn Fishery Management Plan 1991 and the Nickol Bay Prawn Fishery Management Plan 1991 (both made under the Western Australian Fish Resources Management Act 1994). Additionally, these specimens are included on the exempt list only until 18 November 2009, making compliance time-sensitive and necessitating adherence to this temporal limitation. Failure to comply with the conditions set out in the legislative instrument may result in civil or criminal consequences. While the specific penalties are not detailed in the text, breaches of the Environment Protection and Biodiversity Conservation Act 1999 can generally lead to substantial fines and, in more severe cases, imprisonment. The exact penalties would depend on the nature and severity of the breach, but the Act is clear in its intent to enforce compliance to protect environmental integrity and biodiversity.
