Environment Protection and Biodiversity Conservation Act 1999 - Section 303EC(1)(c)
Amendment of the List of Specimens that are taken to be suitable for live import.

Under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) a live specimen may only be imported if it is included on the list of specimens that are taken to be suitable for live import (the List).
The List was established in accordance with section 303EB of the EPBC Act and has two parts. Part 1 comprises specimens exempt from the need for an import permit under the EPBC Act. Part 2 comprises specimens that can be imported with a permit under the EPBC Act.
The family Balistidae currently appears on Part 1 of the List. At the time the family Balistidae was included in the List, the family Balistidae contained all species which have now been re-classified into two families: a new family Monacanthidae and the original family Balistidae (a list of all the species which have been transferred from the family Balistidae to the family Monacanthidae is outlined in the Table in the Attachment).
Monacanthidae were originally classified as the subfamily Monacanthinae under the Balistidae listing. The taxonomic re-classification was first suggested in 1984 and was based on the number of dorsal spines of each species[1] but was only recently recognised by the scientific community.
Pursuant to paragraph 303EC(1)(c) of the EPBC Act, the purpose of this instrument is to include the family Monacanthidae on Part 1 of the List. This will enable species within the family Monacanthidae to be imported without the need for an import permit under the EPBC Act (which was previously the case prior to this taxonomic change).
Consultation was undertaken with taxonomy advisers from the Australian Biological Resource Study (ABRS) and the Australian Museum, Sydney with respect to this instrument. No further consultation with other Ministers or the public was undertaken with respect to this instrument as it is of a machinery nature required to reflect a taxonomic change.
This instrument is a legislative instrument for the purposes of the Legislative Instruments Act 2003.
The instrument commenced on the day after it was registered on the Federal Register of Legislative Instruments.
