Overview

The Airworthiness Directives 2004, enacted by the Civil Aviation Safety Authority, aims to update and consolidate airworthiness directives for various aircraft models, ensuring compliance with the latest safety standards. This legislative instrument revokes and remakes certain airworthiness directives, addressing issues related to the maintenance, inspection, and safety of specific aircraft components. Enacted under the authority of the Civil Aviation Safety Regulations 1998, the directives are intended to ensure the ongoing airworthiness of aircraft by requiring necessary maintenance actions and addressing identified safety issues. The objective is to maintain and enhance aviation safety by enforcing specific maintenance and inspection procedures mandated by the Civil Aviation Safety Authority.

Scope and Application

The Airworthiness Directives 2004 legislative instrument pertains to the revocation and remaking of various Airworthiness Directives as they apply to specific aircraft models, such as the Bell Helicopter Textron 47 (All Variants) Series Helicopters. This legislative instrument, issued by David Alan Villiers, a delegate of the Civil Aviation Safety Authority (CASA), operates under subregulation 39.001 (1) of the Civil Aviation Safety Regulations 1998. The instrument revokes a number of previous Airworthiness Directives and replaces them with new ones, ensuring that the directives are up-to-date and reflect the latest safety requirements. The changes apply to all aircraft operators and maintenance personnel within the Commonwealth of Australia and are intended to ensure the continued airworthiness of the specified aircraft. No specific exclusions, exemptions, or thresholds are mentioned in the text, and the application of these directives is comprehensive across all relevant entities and operations within the Australian jurisdiction. The instrument also notes that each Airworthiness Directive is being remade in exactly the same form as appears in the latest published edition of the Directive.

Key Provisions

The legislative instrument (F2006B07761) issued by David Alan Villiers, a delegate of the Civil Aviation Safety Authority, primarily operates under subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998. This instrument revokes certain Airworthiness Directives (ADs) that previously applied to specific Bell Helicopter Textron 47 (All Variants) Series Helicopters, as detailed in Schedule 1, and re-issues them as separate instruments in their current form. The main sections involved are section 1, which outlines the revocation of existing ADs, and section 2, which details the re-making of these ADs. The obligations imposed by the Act on the parties and entities it governs are focused on ensuring compliance with the newly issued ADs. Aircraft owners, operators, and maintenance personnel must adhere to the specific requirements outlined in each AD. These requirements cover a range of areas, such as inspections, modifications, and retirement life limitations for various components of the Bell 47 helicopters. For example, AD/BELL 47/16 mandates inspections and life limitations for tail rotor pitch change bearings, while AD/BELL 47/43 requires modifications to Stewart Warner 439212 fuel quantity gauge units. Failure to comply with these ADs can lead to significant safety risks, making adherence crucial. The legislation does not explicitly outline specific offences, penalties, or consequences for breaches of the ADs within the text itself. However, under the broader Civil Aviation Safety Regulations 1998, non-compliance with ADs can result in substantial penalties. These penalties can include fines and, in severe cases, prosecution under the Civil Aviation Act 1988. The exact penalties may vary depending on the nature and severity of the breach, with potential maximum penalties aligning with the regulatory framework governing civil aviation safety in Australia. The enforcement of these penalties aims to ensure that all aircraft operations maintain the highest safety standards, thereby protecting the public and aviation personnel.
