Overview

The Airworthiness Directives 2004, enacted under the Civil Aviation Safety Regulations 1998, aimed to address issues and gaps in the regulatory framework concerning the airworthiness of aircraft, specifically the Beechcraft 200 (Super King Air) series aeroplanes. The enactment was carried out by David Alan Villiers, the delegate of the Civil Aviation Safety Authority, in accordance with subregulation 39.001 (1) of the Civil Aviation Safety Regulations 1998. The primary policy objective of this legislative instrument was to revoke existing Airworthiness Directives and re-issue them to ensure continued compliance with the latest safety standards and regulatory requirements. Each Airworthiness Directive was remade in exactly the same form as appears in the latest published edition of the Directive to maintain consistency and accuracy in the regulatory framework governing the airworthiness of these aircraft.

Scope and Application

The Airworthiness Directives 2004 legislative instrument, issued by David Alan Villiers as the delegate of the Civil Aviation Safety Authority under subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998, revokes and re-makes a series of airworthiness directives specifically targeting the Beechcraft 200 (Super King Air) Series Aeroplanes. This instrument applies to all persons and entities operating Beechcraft 200 aircraft within Australian airspace, thereby imposing mandatory compliance requirements related to various structural and operational aspects of the aircraft. The scope of these directives covers a range of components and systems including but not limited to the strobe light bonding straps, flap gearbox, propeller secondary low pitch stop system, and numerous other structural and operational elements as detailed in the attached schedules. These directives are intended to ensure that all Beechcraft 200 aircraft meet specified safety standards. The instrument does not specify exclusions or exemptions, implying that all operators of these aircraft are subject to compliance. The application extends nationally within Australia, aligning with the broader jurisdiction of the Civil Aviation Safety Authority.

Key Provisions

The Airworthiness Directives 2004 legislative instrument, enacted by David Alan Villiers, a delegate of the Civil Aviation Safety Authority, primarily serves to revoke existing Airworthiness Directives and re-enact them as separate instruments. Section 2 of the instrument revokes the Airworthiness Directives listed in Schedule 1, while Section 3 mandates the re-enactment of these directives as individual instruments. This process ensures that the directives remain current and aligned with the latest safety standards. Each re-enacted directive in Schedule 1 is identical to the most recent published version. The obligations imposed by this instrument on the parties and entities it governs include strict compliance with the re-enacted Airworthiness Directives. Owners, operators, and maintenance personnel of Beechcraft 200 (Super King Air) series aeroplanes must adhere to the detailed specifications and requirements outlined in each directive. This includes conducting necessary inspections, repairs, and modifications to ensure that the aircraft meet the prescribed airworthiness standards. The directives cover a wide range of components and systems, such as the strobe light bonding straps, flap gearbox, propeller secondary low pitch stop system, and many others. Non-compliance with these directives could potentially compromise the safety and airworthiness of the aircraft. Breach of the Airworthiness Directives can result in significant consequences, both civil and criminal. Civil penalties may include fines and enforcement actions taken by the Civil Aviation Safety Authority. In severe cases, the authority may ground an aircraft until it is brought into compliance. Criminal penalties can also apply, particularly if a breach is found to have contributed to an aviation accident or incident. The maximum penalties for such breaches can vary, but they are designed to ensure that the highest standards of airworthiness and safety are maintained. It is important for all stakeholders to fully understand and comply with the requirements to avoid these serious repercussions.
