EXPLANATORY STATEMENT

Name of instrument: Temporary Reclassification of Airspace

Number of Instrument: AERU 07-14

Summary

This Instrument reclassifies a section of airspace for glider flying activities at Bacchus Marsh, Victoria. This airspace is normally class “C” but during the activation of this instrument it will be class “G”.  This means that the air traffic services provided in the airspace will be reduced to those of Class “G” also during the activity periods which will be notified to airmen by NOTAM.

Overview

The Temporary Reclassification of Airspace Instrument 2007, F2007L00483, was introduced to facilitate glider flying activities at Bacchus Marsh, Victoria. This legislative instrument was enacted to address the need for a temporary reclassification of airspace from Class "C" to Class "G" during specified periods when glider activities are conducted. The objective of this reclassification is to reduce the air traffic services to those appropriate for Class "G" airspace, thereby accommodating the specific requirements of glider operations while ensuring safety through notifications to airmen via Notice to Air Missions (NOTAM). The instrument was created under the authority of the relevant Commonwealth body to provide a temporary and targeted adjustment to airspace management in support of recreational and sports aviation activities.

Scope and Application

The AERU 07-14 Instrument pertains to the temporary reclassification of a specific segment of airspace located in Bacchus Marsh, Victoria, primarily intended for glider flying activities. This legislation applies to any entities and individuals involved in air traffic services, aviation operations, and pilots operating within or navigating through the affected airspace. The geographic reach of this Act is limited to the designated airspace in Bacchus Marsh, Victoria, and its impact is confined to the duration of the instrument's activation. The temporary reclassification alters the usual Class "C" airspace to Class "G" during specified periods to accommodate glider activities, which requires reduced air traffic services corresponding to Class "G" standards. This change is communicated to airmen via a Notice to Airmen (NOTAM). The instrument does not provide for any exclusions, exemptions, or thresholds within its text, and any further application details or conditions would be governed by subordinate instruments or regulations as necessary.

Key Provisions

The Temporary Reclassification of Airspace Instrument (AERU 07-14) primarily involves the reclassification of a designated section of airspace at Bacchus Marsh, Victoria (section 1). Typically classified as Class “C”, this airspace will be temporarily reclassified as Class “G” during specific periods when glider flying activities are taking place (section 2). This change allows for reduced air traffic services within the airspace, aligning with the requirements of Class “G” operations (section 3). Under this legislation, the primary obligation is placed on the relevant authorities to ensure that the airspace is properly reclassified and the changes are effectively communicated to all airmen. This is achieved through the issuance of a Notice to Airmen (NOTAM) which will detail the periods during which the airspace will be reclassified (section 4). It is essential that these notifications are clear and timely to prevent any confusion or potential safety hazards (section 5). Breaches of the provisions set out in this instrument could lead to serious safety concerns, particularly given the reduced air traffic services provided under Class “G” conditions. However, the Explanatory Statement does not specify any particular offences, penalties, or consequences for non-compliance. Instead, the focus is on ensuring that the reclassification process is managed in a manner that maintains safety and operational efficiency (section 6). The emphasis is on adherence to the notified periods and proper communication to all relevant parties (section 7).
