AIR NAVIGATION REGULATIONS (AMENDMENT)
A recent amendment of Paragraph 26(2)(k) of the Air Navigation Act 1920 provided for an increase in the maximum prescribable penalty, from $1000 to $5000, for breaches of Regulations made under the Act.
This amendment of the Air Navigation Regulations increases the penalties provided for breaches of certain Regulations, as set out below.
Sub-regulations 92(A)3 and 92A(6) are amended to provide a fine of $5000 for dumping waste foodstuffs, or failing to comply with a notice to remove dumped waste foodstuffs, within the vicinity of an aerodrome. The previous maximum penalty was $1000.
Regulation 281 concerns unco-operative witnesses at an accident or incident investigation. The penalty has been increased from $40 to $1000 to bring this provision into line with similar provisions in other Commonwealth legislation.
Regulation 312(5) fixes the maximum level of penalties provided for breaches of the Air Navigation Regulations, where a separate penalty is not prescribed. The old level of $1000 has been increased to $5000 for offences prosecuted on indictment and from $400 to $2500 for offences prosecuted summarily.
Regulation 315D concerns erecting or affixing of unauthorised posters, signs and advertisements within the precincts of an aerodrome. The penalty provided has been increased from $100 to $200.
