Overview

The Air Navigation Regulations (Amendment) 1981 (Statutory Rules 1981 No. 771) were enacted to amend the Air Navigation Regulations under the Air Navigation Act 1920. This legislative instrument was introduced to address the need to update and streamline the fees and charges associated with various aviation licenses and examinations, reflecting changes in the regulatory landscape and operational costs within the aviation sector. The regulations were made by the Governor-General, acting on the advice of the Federal Executive Council, and aim to bring clarity and efficiency to the administration of fees related to pilot licenses, maintenance engineer licenses, and associated examinations. The policy objective behind these amendments is to ensure that the regulatory framework remains current and responsive to the evolving requirements of the aviation industry, thereby supporting the safe and efficient operation of air navigation services in Australia.

Scope and Application

The Air Navigation Regulations (Amendment) Statutory Rules 1981 No. 771, made under the Air Navigation Act 1920, primarily focus on the regulation of fees and charges associated with various pilot and aircraft maintenance licences issued in Australia. These regulations apply to individuals and entities involved in air navigation, including pilots, aircraft maintenance engineers, and flight navigators, as well as the entities responsible for issuing and renewing these licences. The scope of the amendment extends to all of Australia, with the regulations applicable nationally. Certain fees for licence examinations and renewals have been amended, and new fees for different types of licences have been introduced. The amendment came into operation on specific dates, with certain provisions effective from 1 July 1980, and others from 1 May 1981. The regulations also allow for further specification and extension of their application through subordinate instruments.

Key Provisions

The Air Navigation Regulations, amended by Statutory Rules 1981 No. 771, include several key operative sections. Regulation 2 and sub-regulation 3(1) came into effect on 1 July 1980, while sub-regulation 3(2) took effect on 1 May 1981. Regulation 329 was modified to remove certain phrases and sub-regulations, which relate to fees and charges for pilot licences. The Schedule was updated to reflect new fees for various types of licences and examinations, including those for private, commercial, senior commercial, and airline transport pilot licences. Furthermore, the Schedule also includes fees for the issue of flight engineer and flight navigator licences, and for the first renewal of these licences. The obligations and requirements imposed by these regulations include the payment of specific fees for the issue and renewal of various types of pilot and engineer licences. For instance, the issue of a private pilot licence now requires a fee of $10.00, while the issue of a commercial pilot licence costs $20.00. Similarly, the issue of a flight engineer licence is subject to a fee of $10.00. In addition, the regulations specify fees for the first renewal of certain licences, such as the renewal of a pilot licence (not being a student pilot licence) which is $10.00, and the renewal of an aircraft maintenance engineer licence which is $6.00. These fees are mandatory and must be paid by the individuals or entities applying for or renewing these licences. There are no explicit references to offences, penalties, or civil/criminal consequences for non-compliance with these regulations within the text provided. However, it is reasonable to infer that failure to pay the prescribed fees or comply with the regulatory requirements could lead to legal consequences. These could include the denial of licence issue or renewal, which would impede the individual's ability to legally operate aircraft or perform certain aviation-related roles. The specific penalties for such breaches would be determined by the broader aviation regulatory framework and could potentially involve fines or other administrative actions.
