Overview

The Air Navigation (Charges) Amendment Act 1982, enacted by the Commonwealth Parliament, is a legislative amendment to the Air Navigation (Charges) Act 1952. This Act was introduced to address the need for updated financial provisions in the context of air navigation charges and aircraft licensing categories. The policy objective was to adjust the financial framework to reflect changes in operational costs and to accommodate new categories of airline and charter licences. The Act includes provisions for increasing air navigation charges and modifying the licensing categories to include cargo operations, reflecting the evolving nature of the aviation industry. The Act's amendments are structured to take effect from specific dates, ensuring a smooth transition for all stakeholders involved in air navigation services.

Scope and Application

The Air Navigation (Charges) Amendment Act 1982 amends the Air Navigation (Charges) Act 1952 and applies to charges payable in respect of flights, take-offs, or landings completed on or after 1 October 1982, as well as to years of aircraft registration commencing on or after that date. This Act pertains to the modification of financial charges levied for various air navigation services and introduces amendments to the categories of licences for airlines and charters. It applies nationally, covering all air navigation services within Australia, and affects both domestic and international flights. The Act does not specify any exclusions, exemptions, or thresholds but does note that the amendments apply to certain defined licence categories, including airline and cargo airline licences, as well as charter and cargo charter licences. The scope of the Act may be extended or restricted through subordinate instruments, though this is not detailed in the provided text.

Key Provisions

The Air Navigation (Charges) Amendment Act 1982 (C2004A02636) amends the Air Navigation (Charges) Act 1952, introducing changes to the fees associated with air navigation services and expanding the categories of licences subject to these charges. The Act is divided into three parts, each addressing different aspects of the amendments. Sections 1 and 2 of the Act, which relate to its citation and commencement, are effective immediately upon receiving Royal Assent. The substantive amendments concerning increases in charges and licence categories, outlined in Parts II and III, are scheduled to come into operation on specific dates, either 1 October 1982 or a date to be fixed by Proclamation. The Act imposes specific obligations on the parties governed by it. For example, the amendments to the fees for air navigation services, detailed in Schedules 1 and 2, apply to charges payable for flights or take-offs and landings completed on or after 1 October 1982. Similarly, the amendments to the categories of licences subject to these fees apply to aircraft registrations commencing on or after the same date. Additionally, the Act requires that the updated fee schedules be adhered to when billing for air navigation services, ensuring that all relevant charges are in line with the new legislative provisions. There are no explicit provisions detailing offences, penalties, or civil/criminal consequences for breaches of this Act within the text provided. However, it is standard practice for legislative amendments to carry potential penalties for non-compliance, which might be outlined in the primary Act (Air Navigation (Charges) Act 1952) or in other related legislation. Typically, breaches of aviation-related regulations can lead to fines, enforcement actions, or other regulatory sanctions, although the specifics would need to be referenced from the broader legal framework governing air navigation charges in Australia.
