Air Navigation (Charges) Amendment Act 1980

An Act to amend the Air Navigation (Charges) Act 1952, and for related purposes

[Assented to 19 September 1980]

BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows:

Short title, &c.

1. (1) This Act may be cited as the Air Navigation (Charges) Amendment Act 1980.

(2) The Air Navigation (Charges) Act 1952 is in this Act referred to as the Principal Act.

Commencement

2. This Act shall come into operation on 1 December 1980.

Regulations

3. Section 6 of the Principal Act is amended by omitting sub-section (2) and substituting the following sub-section:

“(2) The regulations—

(a) may, in respect of a flight not specified in the Table in Schedule 1 (including a flight to a place that commences and ends at the one place and is not by way of an intermediate stopping place or intermediate stopping places), prescribe a factor for the purposes of paragraph 4 or 6 of that Schedule; and

(b) shall, in respect of a flight for which a factor is so prescribed for the purposes of paragraph 4 of that Schedule, state whether that flight is to be deemed to be a flight specified in Part I or Part II of that Table.”.

Schedule 1—paragraph 2c

4. After paragraph 2b of Schedule 1 to the Principal Act the following paragraph is inserted:

“2c. (1) For the purposes of paragraphs 3 and 4—

(a) a flight from the first-mentioned place in an item in Part I or Part II of the Table in this Schedule to the second-mentioned place in that item; and

(b) a flight from the second-mentioned place in such an item to the first-mentioned place in that item,

is, subject to sub-paragraph (2), referred to in this Schedule as a flight specified in column 2 of Part I or Part II, as the case may be, of that Table.

“(2) Where, in an item in Part I or Part II of the Table in this Schedule, reference is made to a flight between 2 places by way of a place specified in that item or by way of a route specified in that item, a flight between those 2 places that is a flight by way of that specified place or by way of that specified route is referred to in this Schedule as a flight specified in column 2 of Part I or Part II, as the case may be, of that Table.

“(3) A reference in Part I or Part II of the Table in this Schedule to a place shall be construed as including a reference to an airport in the vicinity of that place that is regularly used for the commencement or completion of the carriage by air of passengers or goods in the course of their travelling or being sent from that place to another place or to that place from another place.”.

Schedule 1—paragraph 3

5. Paragraph 3 of Schedule 1 to the Principal Act is amended—

(a) by omitting from sub-paragraph (1) “For” and substituting “Subject to sub-paragraph (1a), for”; and

(b) by inserting after sub-paragraph (1) the following sub-paragraph:

“(1a) Sub-paragraph (1) does not apply in relation to a flight between 2 places by way of an intermediate stopping place or intermediate stopping places if—

(a) the flight;

(b) a flight between either of those two places and that intermediate stopping place or any of those intermediate stopping places; or

is a flight that is specified, or deemed to be specified, in column 2 of Part II of the Table in this Schedule.”.

Schedule 1—paragraph 4

6. Paragraphs 4 and 5 of Schedule 1 to the Principal Act are omitted and the following paragraph is substituted:

“4. (1) Subject to sub-paragraph (3), the amount of the charge payable under paragraph 1, 2, 2aa, 2a or 2b in respect of a flight by an aircraft (not being an aircraft to which paragraph 7a applies) is—

(a) if the flight is a flight specified, or deemed to be specified, in column 2 of Part I of the Table in this Schedule—the amount ascertained by multiplying the unit charge for the aircraft under paragraph 7 by the factor specified in column 3 of that Part of that Table opposite to that flight or prescribed in respect of that flight, as the case may be;

(b) if the flight is a flight specified, or deemed to be specified, in column 2 of Part II of the Table in this Schedule—the amount ascertained by multiplying the unit charge for the aircraft under paragraph 7aa by the factor specified in column 3 of that Part of that Table opposite to that flight or prescribed in respect of that flight, as the case may be; or

“(2) Subject to sub-paragraph (3), the amount of the charge payable under paragraph 1, 2, 2aa, 2a or 2b in respect of a flight by an aircraft to which paragraph 7a applies is—

(a) if the flight is a flight specified, or deemed to be specified, in column 2 of Part I or Part II of the Table in this Schedule—the amount ascertained by multiplying the unit charge for the aircraft under paragraph 7a by the factor specified in column 3 of Part I or Part II, as the case may be, of that Table opposite to that flight or prescribed in respect of that flight, as the case may be; or

(b) in any other case—an amount equal to the unit charge for the aircraft under paragraph 7a.

“(3) Where a flight by an aircraft between 2 places by way of an intermediate stopping place or intermediate stopping places includes—

(a) travel between places that are places in respect of flights between which a factor is specified in the Table in this Schedule or is prescribed by the regulations; and

(b) other travel that is not between such places,

the amount of the charge payable under paragraph 1, 2, 2aa, 2a or 2b is the sum of the amount that would be payable if the flight were confined to the travel referred to in clause

(a) of this sub-paragraph and an amount equal to—

(c) if the aircraft is an aircraft to which paragraph 7a applies—the unit charge for the aircraft under that paragraph; or

(d) in any other case—the unit charge for the aircraft under paragraph 7.

“(4) For the purposes of this paragraph—

(a) a flight to Antarctica that commences and ends at Melbourne and is not by way of an intermediate stopping place or intermediate stopping places shall be deemed to be a flight specified in column 2 of Part I of the Table in this Schedule and the factor 8 shall be deemed to be the factor specified in column 3 of that Part of that Table opposite to that flight; and

(b) a flight to Antarctica that commences and ends at Sydney and is not by way of an intermediate stopping place or intermediate stopping places shall be deemed to be a flight specified in column 2 of Part I of that Table and the factor 12 shall be deemed to be the factor specified in column 3 of that Part of that Table opposite to that flight.”.

Schedule 1—paragraph 5a

7. Paragraph 5a of Schedule 1 to the Principal Act is amended by inserting after sub-paragraph (2) the following sub-paragraph:

“(2a) A reference in sub-paragraph (2) to the unit charge for an aircraft shall be construed as a reference to—

(a) if the aircraft is an aircraft to which paragraph 7a applies—the unit charge for the aircraft under that paragraph; or

(b) in any other case—the unit charge for the aircraft under paragraph

Schedule 1—paragraph 6

8. Paragraph 6 of Schedule 1 to the Principal Act is amended—

(a) by omitting from clause (a) of sub-paragraph (3) “Part II” and substituting “Part III”;

(b) by inserting in sub-paragraph (3) “under paragraph 7a” after “the unit charge for the aircraft” (wherever occurring);

(d) by omitting from clause (a) of sub-paragraph (7) “Part II” and substituting “Part III”.

Schedule 1—paragraph 7

9. Paragraph 7 of Schedule 1 to the Principal Act is amended by inserting “under this paragraph” after “the unit charge”.

Schedule 1—paragraph 7aa

10. After paragraph 7 of Schedule 1 to the Principal Act the following paragraph is inserted:

“7aa. For the purposes of this Schedule, the unit charge under this paragraph for an aircraft (not being an aircraft to which paragraph 7a applies) is—

(a) if the weight of the aircraft is not more than 700 kilogrammes—14.4 cents;

(b) if the weight of the aircraft is more than 700 kilogrammes but not more than 9,000 kilogrammes—25.2 cents for each 450 kilogrammes, or part of 450 kilogrammes, of the weight of the aircraft;

(c) if the weight of the aircraft is more than 9,000 kilogrammes but not more than 20,000 kilogrammes—$5.04 plus 60.2 cents for each 500 kilogrammes, or part of 500 kilogrammes, by which the weight of the aircraft exceeds 9,000 kilogrammes;

(d) if the weight of the aircraft is more than 20,000 kilogrammes but not more than 100,000 kilogrammes—$18.28 plus 74.1 cents for each 500 kilogrammes, or part of 500 kilogrammes, by which the weight of the aircraft exceeds 20,000 kilogrammes; or

(e) if the weight of the aircraft is more than 100,000 kilogrammes— $136.34 plus 68.5 cents for each 500 kilogrammes, or part of 500 kilogrammes, by which the weight of the aircraft exceeds 100,000 kilogrammes.”.

Schedule 1—paragraph 7a

11. Paragraph 7a of Schedule 1 to the Principal Act is amended by inserting “under this paragraph” after “the unit charge”.

Application of amendments

13. The amendments of the Principal Act made by this Act apply in relation to a charge payable in respect of a flight completed on or after 1 December 1980 or a take-off or landing on or after that date.
