(3.) Where the value that any land to which this regulation applies had immediately before the prescribed date was diminished by reason of the restrictions that were, on and from the prescribed date, imposed on the construction of buildings or other structures on the land by the Air Navigation (Buildings Control) Regulations, the Commonwealth is, subject to the succeeding provisions of this regulation, liable to pay an amount equal to the amount by which the value of the land was so diminished as compensation in respect of that diminution in value.

Overview

The Air Navigation (Buildings Control) Regulations 1967, made under the Air Navigation Act 1920-1966, aim to address the problem of potential hazards to air navigation caused by the construction of buildings in specified areas around major Australian airports. Enacted by the Parliament of Australia, these regulations seek to ensure the safety and efficiency of air navigation by controlling the height and placement of buildings near key aerodromes. The policy objective is to mitigate risks to aircraft by prohibiting the construction of buildings over a certain height in areas identified as critical for air traffic. The regulations also provide a mechanism for compensation to landowners whose property values may be adversely affected by these restrictions.

Scope and Application

These regulations, made under the Air Navigation Act 1920-1966, apply to the construction and marking of buildings and structures within specified areas around selected aerodromes to ensure air navigation safety. Specifically, they concern the prohibition of constructing buildings over certain heights without approval in areas delineated by the regulations. The Act applies to any person wishing to construct buildings or structures in these areas, which are identified in the schedules and detailed by specific hachuring on plans referenced within the Fifth Schedule. The regulations cover aerodromes in Sydney (Kingsford Smith) Airport, Bankstown Airport in New South Wales, and Moorabbin Airport and Adelaide Airport in Victoria and South Australia, respectively. The scope of the regulations is extended by the various schedules, which detail the exact areas around each aerodrome. Additionally, these regulations provide for the application process for approvals, the marking of buildings or structures, and the removal or marking of hazards to air navigation. Notably, the regulations also address compensation for the diminution in value of land due to the restrictions imposed on building construction, stipulating that compensation is payable under specific conditions and procedures. The application of these regulations is subject to amendment by subordinate instruments, thereby allowing for flexibility and adaptation to changing circumstances.

Key Provisions

The Air Navigation (Buildings Control) Regulations 1967 (as amended) introduce specific controls over building construction in areas near aerodromes to ensure the safety of aircraft operations. Regulation 3 now references the Fifth Schedule instead of the Fourth Schedule, and Regulation 4 similarly makes this change, thereby updating the areas subject to height restrictions. Regulation 4a prohibits the construction of any building or structure over 50 feet in height in specified areas without approval, with a penalty of a fine of up to $1,000 or imprisonment for up to six months. Regulation 5 has been amended to reflect these changes, substituting the Fourth Schedule with the Fifth Schedule in two instances. Regulation 6 has been updated to include reference to the new Regulation 4a, ensuring that applications for approval must now also consider this new regulation. Regulation 7 now allows the Minister to impose conditions regarding the marking of buildings or structures in addition to the conditions under which approval was given. Regulation 9 further elaborates on the removal or marking of hazards to air navigation, clarifying that these actions apply to buildings, structures, or objects named in the description of specified areas, particularly those over 50 feet in height. These regulations impose several obligations on the parties and entities they govern. Primarily, any person planning to construct a building or structure in the specified areas must seek approval from the relevant authorities, ensuring that the construction does not impede air navigation. Owners of land in these areas must comply with the height restrictions and any conditions imposed by the Minister regarding the construction and marking of buildings or structures. Additionally, any person required to remove or mark hazards to air navigation must do so in accordance with the regulations. Violations of these regulations can lead to significant consequences. Constructing a building or structure over the height limits without approval is subject to a penalty of up to $1,000 or imprisonment for up to six months. Failure to remove or mark hazards to air navigation as required can also lead to enforcement actions. Furthermore, the regulations include provisions for compensation to landowners whose property values are diminished due to the restrictions on building heights, provided they apply for compensation within the specified timeframe and meet the criteria set out in the regulations.
