Air Force Regulations (Amendment)

The Air Force Regulations ("the Principal Regulations") made under the Air Force Act 1923, set out, inter alia, the conditions of service for members of the Air Force.

Subregulation 118(1) of the Principal Regulations provides that the compulsory retirement age of all airmen in the Air Force shall be 55. Subregulation 118(2) of the Principal Regulations provided that, in special cases the Minister may, by instrument in writing, extend the prescribed age for retirement of an airman for a period not exceeding two years. (In the case of officers in the Air Force, the Principal Regulations enable the Minister to extend the prescribed retirement age of an officer in the Permanent Air Force for a period not exceeding two years, and to an age not exceeding 60 years for an officer in the Air Force Reserve.)

In order to bring the power to extend the prescribed retirement age of an airman in the Air Force Reserve into line with the power to extend the prescribed retirement age of an officer in the Air Force Reserve, this Statutory Rule amends subregulation 118(2) so that the prescribed retirement age of an airman in the Air Force Reserve may be extended to an age not exceeding 60 years. (The power to extend the prescribed retirement age of an airman in the Permanent Air Force by two years is not affected by this amendment.)

As the power to extend the prescribed retirement age of an airman in the Air Force Reserve applies to all airmen, including those currently serving, this Statutory Rule does not contain a transitional provision.
