Overview

The Air Force Regulations 1967, made under the Air Force Act 1923-1965, address the need for updated and comprehensive pay and allowance rates for members of the Australian Air Force. Enacted by the Governor-General in Council, these regulations provide specific daily rates of pay for officers, cadets, airmen, apprentices, and chaplains, reflecting their rank, service duration, and course of study. Additionally, the regulations adjust various allowances such as marriage, living out, and travel allowances, ensuring they are in line with contemporary standards. This legislative instrument aims to maintain fair and adequate compensation for the diverse roles within the Air Force, reflecting the evolving nature of service and the need for updated remuneration structures.

Scope and Application

The Statutory Rules 1967 No. 104, Regulations under the Air Force Act 1923-1965, govern the pay and allowances for members of the Australian Air Force, including officers, chaplains, cadets, and airmen. These regulations apply to all personnel serving in the Air Force from the 6th of July, 1967. They encompass various ranks and classifications, specifying the daily rates of pay based on service length and rank. The regulations also detail allowances for marriage, living out, and rations, among others. Notably, they provide for specific adjustments to rates that were previously set, ensuring the updated rates apply from the specified commencement date. Certain transitional provisions are included to protect the entitlements of personnel who might otherwise lose or see reduced allowances due to the changes, such as allowing an increase in allotments to maintain existing marriage allowance rates until the regulations officially commence. This legislation is a Commonwealth matter, binding all Air Force personnel across Australia, and there are no exclusions specified within the text. The scope of the Act is further extended through subordinate instruments, which may detail additional specifics or applications of the regulations.

Key Provisions

The key provisions of these Regulations under the Air Force Act 1923-1965 primarily pertain to the amendments of the Air Force Regulations concerning the pay rates and allowances for various ranks and classifications within the Air Force. Section 1 amends Regulation 543 by updating the daily pay rates for officers based on their rank and years of service. This includes changes for Group Captains, Wing Commanders, Squadron Leaders, Flight Lieutenants, and other officer ranks. Section 2 adjusts the consolidated rates of pay, as specified in Regulation 544. Section 3 revises the pay rates for air cadets according to their age and year of training, as per Regulation 548. Section 4 updates the pay rates for airmen based on their rank and years of service, as outlined in Regulation 549. Section 5 modifies the pay rates for airmen in aircrew musterings, as per Regulation 550. Section 6 sets new pay rates for airmen apprentices based on their training period and age, as per Regulation 551. Additionally, Section 7 amends the marriage allowance rates in Regulation 555, while Section 8 updates the conditions for marriage allowance in Regulation 555a. Section 9 revises the living out allowance for single members in Regulation 567, and Section 10 adjusts the ration allowance in Regulation 569. Section 11 updates the rates of travelling allowance in Regulation 578, and Section 12 modifies the reduction of rate when subsistence or quarters are provided in Regulation 590. These Regulations impose specific obligations on the Air Force to ensure the updated pay rates and allowances are accurately applied to eligible members. This includes ensuring that officers, airmen, air cadets, and apprentices receive the correct daily pay rates based on their rank, years of service, and other relevant criteria. The Regulations also require adherence to the updated rates for allowances such as marriage, living out, ration, and travelling allowances. The Air Force must ensure that these changes are implemented correctly and that affected members are duly informed of the updated rates. Breach of these Regulations could lead to non-compliance with the updated pay rates and allowances, potentially resulting in financial discrepancies for Air Force members. While specific offences, penalties, or consequences are not detailed in these Regulations, failure to adhere to the updated rates could lead to legal or administrative repercussions under the broader framework of the Air Force Act 1923-1965 and related legislation.
