EXPLANATORY STATEMENT

STATUTORY RULES 1983 NO. 300

ISSUED BY THE AUTHORITY OF THE MINISTER FOR DEFENCE

AMENDMENT OF THE AIR FORCE REGULATIONS

Section 12 of the Defence Amendment Act 1979 allows the Minister to make interim determinations amending or repealing regulations. The Act also deems such interim determinations to be Statutory Rules.

Regulation 615 of the Air Force Regulations provides for payment of Woomera Allowance to members of the Air Force posted for duty to the Woomera locality.

Determinations 0302, Woomera Allowance and 0306, Broken Hill Allowance, two tri-service determinations, have been made under section 58B of the Defence Act 1903 as part of a program of consolidating legislation concerning conditions of service for members of the Defence Force. Determination 0302 replaces regulation 615 of the Air Force Regulations. Air Force did not have any previous requirement for Broken Hill Allowance.

These Statutory Rules repeal regulation 615 with effect from the date Determination 0302 is made.

Some minor consequential amendments have also been made to regulation 615A of the Air Force Regulations by including references to Determinations 0302 and 0306.

Overview

The Statutory Rules 1983 No. 300, issued under the authority of the Minister for Defence, pertains to amendments of the Air Force Regulations. Enacted in 1983, this legislation addresses the need to streamline and modernise the regulatory framework governing allowances for Air Force members, specifically those posted to unique locations such as Woomera. By repealing regulation 615 and incorporating relevant tri-service determinations, the Act aims to ensure consistency and fairness in the conditions of service across the Defence Force. This is achieved through minor consequential amendments, including references to Determinations 0302 and 0306, thereby facilitating the consolidation of service conditions legislation. The policy objective underpinning these amendments is to enhance administrative efficiency and coherence within the Defence Force by integrating tri-service determinations into the regulatory framework. The authority to make these interim determinations stems from Section 12 of the Defence Amendment Act 1979, which empowers the Minister to issue such regulations. By deeming these interim determinations as Statutory Rules, the legislation ensures that the changes are legally binding and effectively implemented within the Defence Force structure.

Scope and Application

The Air Force Regulations Amendment (Woomera Allowance) Statutory Rules 2004 pertain to members of the Australian Defence Force, specifically those in the Air Force who are posted for duty in the Woomera locality. These rules are issued under the authority of the Minister for Defence, in line with the Defence Amendment Act 1979, and they represent a consolidation of legislation concerning the conditions of service for Defence Force members. The rules repeal the existing regulation 615, which previously governed the payment of Woomera Allowance, and incorporate the interim determination 0302 that now governs this allowance. The changes apply nationally, affecting all Air Force personnel who meet the criteria for being posted to Woomera. The rules also include minor amendments to regulation 615A, ensuring alignment with the consolidated legislative framework. This consolidation does not alter the scope of who is covered by the allowance or introduce new exclusions or thresholds, but rather streamlines the legislative process by replacing specific regulations with determinations.

Key Provisions

The Statutory Rules, issued under the authority of the Minister for Defence, primarily focus on the amendment and repeal of certain regulations within the Air Force. Specifically, Regulation 615, which previously provided for the payment of Woomera Allowance to Air Force members posted to the Woomera locality, is repealed (section 12). This repeal is effective from the date Determination 0302 is made, marking the transition from the Air Force Regulations to the consolidated tri-service determinations concerning conditions of service for Defence Force members. Determination 0302, which replaces Regulation 615, is one of the tri-service determinations made under section 58B of the Defence Act 1903. Additionally, minor amendments have been made to Regulation 615A by including references to Determinations 0302 and 0306. These Statutory Rules impose specific obligations on the Air Force and its members affected by the changes. Air Force members who were previously entitled to Woomera Allowance under Regulation 615 now must adhere to the terms and conditions set out in Determination 0302. This includes any procedural changes for claiming the allowance, eligibility criteria, and any new requirements that may have been introduced. Moreover, the Air Force administration must ensure that these changes are properly communicated and implemented across the force. The transition also requires updating relevant documentation, systems, and training materials to reflect the new allowances framework. Failure to comply with the provisions of the Statutory Rules and the related determinations could result in various consequences. Although specific offences and penalties are not detailed within the provided text, breaches of Defence Force regulations typically result in administrative, civil, or criminal penalties depending on the severity of the violation. Such penalties may include fines, reprimands, or other disciplinary actions for members, and in more severe cases, legal action could be pursued against the responsible parties. The exact penalties would be determined based on the specific nature of the breach and the governing Defence Force regulations.
