Overview

The Statutory Rules of 1961, No. 95, pertain to the Air Force Act 1923-1956 and were introduced to address the need for updating and amending the existing Air Force Regulations. These Regulations were enacted by the Administrator of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council. The purpose of these amendments was to adjust various allowances, rates of pay, and conditions of service for members of the Australian Air Force, ensuring that compensation structures are equitable and reflective of contemporary standards. This legislative instrument was published in the Commonwealth Gazette on 27th July 1961 and came into operation on 13th July 1961.

Scope and Application

The Air Force Regulations, as amended by Statutory Rules 1961, No. 95, apply to members of the Australian Air Force, including officers and enlisted personnel, as well as certain other categories such as air cadets and trainees. These regulations govern various aspects of their service, including pay, allowances, and other conditions of employment. The amendments are made under the authority of the Air Force Act 1923-1956 and are applicable on a national level within the Commonwealth of Australia. The scope of these amendments primarily focuses on adjustments to monetary values related to pay, allowances, and rates in response to inflation or other economic considerations. There are no stated exclusions or exemptions in these particular regulations; however, the application may be subject to further refinement or specification through subordinate instruments or additional legislative amendments.

Key Provisions

The main operative sections of the Regulations under the Air Force Act 1923-1956 include amendments to the Air Force Regulations, particularly concerning pay and allowances for members of the Air Force (sections 2-11). Regulation 2 introduces a new Division 2A to address variations in pay (section 3). Regulation 552B specifies the increased rates of active pay for different categories of Air Force members, such as male and female members, officers, cadets, and trainees (section 4). Other regulations adjust various allowances and rates, such as the marriage allowance, living out allowance for single members, ration allowance, retention of lodgings allowance, and rates of travelling allowance (sections 5-11). The Regulations impose several obligations and requirements on the parties governed by the Air Force Act. The amendments necessitate adjustments to the pay and allowances of Air Force members, ensuring that they receive appropriate compensation based on their roles and circumstances. These changes apply to all members entitled to the specified allowances and rates. The amendments also require compliance with the updated conditions and rates for marriage allowances and other allowances as stipulated in the Regulations. Breaches of the provisions outlined in the Regulations can result in civil and criminal consequences. While the Regulations themselves do not explicitly state penalties for non-compliance, the Air Force Act 1923-1956 may provide for penalties under other sections. For instance, disobedience of lawful orders or neglect of duty could result in disciplinary action under the Act, which might include fines or imprisonment. However, the exact penalties would depend on the specific provisions of the Air Force Act and any relevant case law.
