Overview

The Air Force Regulations 1973, made under the Air Force Act 1923-1965, were enacted to amend and clarify certain provisions within the Air Force Regulations. This legislative instrument was created by the Governor-General in accordance with the advice of the Federal Executive Council, reflecting the need for periodic updates to ensure the regulations remain relevant and effective. The regulations aim to provide updated financial allowances and benefits for Air Force personnel, instructors in the Air Training Corps, and witnesses at Air Force tribunals, thereby addressing the need for adjustments to reflect changes in the economic environment and the operational requirements of the Air Force. These amendments were intended to streamline and modernise the administrative framework governing the Air Force, ensuring that it operates efficiently and fairly.

Scope and Application

The Statutory Rules 1973 No. 97, made under the Air Force Act 1923-1965, primarily target personnel within the Australian Defence Force, specifically those in the Air Force. These regulations are applicable to both the Permanent Air Force and the Air Training Corps, extending to any person or entity involved in military activities or operations under the oversight of the Air Force. The scope includes amendments to allowances, uniform issues, and other benefits for personnel undergoing training or serving in various ranks and appointments. These regulations apply across the Commonwealth of Australia and are not restricted by state or territory boundaries. The changes primarily involve financial adjustments, such as the outfit allowance and the rates of allowances for different ranks and appointments, which were updated to reflect the new rates effective from specific dates. Notably, the regulations do not specify exclusions or exemptions, indicating a broad application across the board for eligible personnel. While the primary focus is on financial and administrative adjustments, these regulations extend their application through the Air Force Regulations, which may be further detailed or modified by subordinate instruments as necessary.

Key Provisions

The main operative sections of these Regulations under the Air Force Act 1923-1965 include amendments to various regulations concerning marriage of personnel undergoing flying training, issue of uniforms, allowances for personnel, and fees and travelling expenses for witnesses at Air Force tribunals. Regulation 74a, which dealt with the marriage of personnel undergoing flying training, has been repealed (section 1). The issue of uniforms for personnel first appointed or enlisted in the Permanent Air Force has been updated, with the cost increased from forty-two to forty-seven dollars (section 2). Allowances for personnel in various ranks and appointments have been revised, with new rates provided for attendance at Air Training Corps training parades (sections 3 and 4). Lastly, regulations concerning fees and travelling expenses for witnesses at Air Force tribunals have been amended to provide a more flexible payment system, aligning with the Public Works Committee Regulations (section 5). These Regulations impose specific obligations and requirements on various parties, including members of the Defence Force, instructors in the Air Training Corps, and witnesses at Air Force tribunals. For Defence Force members, the new uniform cost and updated allowance rates must be adhered to. Instructors in the Air Training Corps must ensure they are compensated according to the new rates for attendance at training parades. Witnesses at Air Force tribunals must comply with the new fee and expense payment system, which aligns with the Public Works Committee Regulations. For breaches of the Regulations, there are no explicitly stated offences, penalties, or civil/criminal consequences within the text provided. However, failure to adhere to the stipulated allowances, fees, and other requirements may result in disputes or claims for non-compliance. The regulations themselves do not specify penalties for non-compliance, but it can be inferred that legal action or administrative measures could be taken if obligations are not met, as is typical in statutory compliance contexts.
