Overview

The Statutory Rules 1961 No. 14, made under the Air Force Act 1923-1956, were enacted by the Governor-General, acting with the advice of the Federal Executive Council, on 2 February 1961. This legislative instrument addresses amendments to the Air Force Regulations to clarify and streamline the provisions concerning the Citizen Air Force. It was introduced to ensure that the regulations governing the Citizen Air Force are aligned with current operational needs and practices. The primary objective of these regulations is to provide clear guidelines on the pay, allowances, and benefits for members of the Citizen Air Force, ensuring fairness and consistency with those of the Permanent Air Force. These regulations amend existing provisions by, for example, reducing the number of specific regulations that pertain to the Citizen Air Force, repealing outdated or redundant sections, and introducing new provisions that reflect changes in policy and practice. The amendments also aim to ensure that members of the Citizen Air Force receive appropriate compensation and benefits for their service, whether on a part-time or full-time basis, thereby maintaining morale and encouraging participation in the defence of Australia.

Scope and Application

The Air Force Regulations 1961, made under the Air Force Act 1923-1956, govern the administration and conduct of members of the Citizen Air Force within the Commonwealth of Australia. These regulations pertain to matters such as rates of pay, allowances, benefits, and the issue of uniforms and necessaries for Citizen Air Force members. The Act applies to individuals who are members of the Citizen Air Force, a component of the Australian Defence Force. The regulations are intended to provide clarity and consistency in the compensation and benefits for Citizen Air Force members, ensuring they receive pay and allowances comparable to their counterparts in the Permanent Air Force. Additionally, these regulations allow for specific allowances to be paid under certain conditions, such as when a member transitions to full-time service with the Permanent Air Force or when an officer of the medical branch requires a locum tenens. The provisions are designed to be comprehensive and adaptable, with the Air Board having the authority to determine the specific conditions and rates applicable to various allowances and benefits.

Key Provisions

The primary sections of these Regulations, under the Air Force Act 1923-1956, involve amendments to existing regulations and the introduction of new provisions specifically concerning the Citizen Air Force. Regulation 2 has been amended to reduce the number of regulations governing the Citizen Air Force from 18 (Regulations 646-663) to just three (Regulations 646-648). Regulation 453b has been repealed, streamlining the regulatory framework. Furthermore, Division 12 of Part XI, which previously covered various aspects of the Citizen Air Force, has been repealed and replaced with a new Division 12 that focuses solely on rates of pay (Regulation 646), allowances and other benefits (Regulation 647), and the issue of uniforms and necessaries (Regulation 648). These Regulations impose several obligations on the parties involved, primarily focusing on the Citizen Air Force members. Members of the Citizen Air Force must adhere to the pay scales set forth in Regulation 646, which align their daily rates of active pay with those of the Permanent Air Force members of the same rank or classification. Furthermore, Regulation 647 outlines the allowances and benefits to which Citizen Air Force members may be entitled, such as marriage allowance, separation allowance, and efficiency allowances, subject to conditions determined by the Air Board. Additionally, Regulation 648 governs the issue and retention of uniforms and necessaries for Citizen Air Force members, stipulating conditions for the free issue, replacement, and retention of these items. Violation of the provisions set out in these Regulations can result in various legal consequences. While the Regulations themselves do not explicitly state penalties for non-compliance, breaches of the Air Force Act 1923-1956 or related regulations could potentially incur penalties under the Act. For instance, disobeying a lawful command or committing an act of insubordination could lead to disciplinary action, fines, imprisonment, or both, depending on the severity of the offence and the specific provisions of the Act. It is crucial for all parties involved to familiarise themselves with the full scope of the Air Force Act 1923-1956 and its associated regulations to ensure compliance and avoid potential penalties.
