Overview

The Defence Amendment Act 1979 was enacted to address gaps and problems in the regulation of allowances and other benefits for members of the Australian Defence Force. This legislation was introduced by the Parliament of Australia, with the intent to ensure that the allowances and benefits provided to Defence personnel are fair, consistent, and reflective of contemporary economic conditions. The 1979 Amendment aimed to modernise and rationalise the regulatory framework governing the Australian Defence Force, particularly focusing on the financial entitlements of its members. The policy objective was to provide clear and updated guidelines that would support the operational efficiency and morale of the Defence Force by ensuring that all allowances and benefits were up-to-date and adequately reflected the cost of living and service requirements.

Scope and Application

The Air Force Regulations 1981 (Amendment) Interim Determination revises specific allowances for meals for officers within the Australian Defence Force during authorized journeys, effective from 1 May 1981. This amendment applies to members of the Australian Defence Force, particularly focusing on authorised journeys as defined in Division 7 of Part XI of the Air Force Regulations. It alters the rates of meal allowances for different ranks of officers, both within capital cities and outside, and modifies the rates for overnight accommodation expenses. The changes are explicitly targeted at adjusting financial provisions for meals and lodging, ensuring that officers receive appropriate reimbursement based on their rank and location during authorised journeys. The regulations apply across Australia, as they are part of the Commonwealth's legislative framework, and are not restricted to any specific state or territory jurisdiction.

Key Provisions

The main operative sections of this legislation (Air Force Regulations 2 (Amendment) Interim Determination) are sections 1 and 2. Section 1 amends Regulation 579 of the Air Force Regulations to update the meal allowance rates for authorized journeys. The changes include updating the rates for breakfast, lunch, and dinner for Air Commodores and higher ranks, as well as Group Captains and lower ranks, both within and outside capital cities (paragraph 1(a) and 1(b)). Additionally, section 1 amends sub-regulation (3) to update the rates for daily allowances from $5.90 to $6.45 and from $4.30 to $4.70 (paragraph 1(c)). Section 2 specifies that the amended Air Force Regulations apply to authorized journeys made on or after 1 May 1981. The Air Force Regulations, as amended, impose specific obligations on individuals who undertake authorized journeys under the Air Force. These obligations include adherence to the updated meal allowance rates and daily allowances as specified in the amended Regulation 579. The updated rates ensure that personnel are reimbursed appropriately for their expenses during authorized journeys, taking into account their rank and the location of the journey. There are no explicit offences, penalties, or civil/criminal consequences outlined in this Interim Determination for breaches of the updated meal and daily allowances. However, non-compliance with these updated rates could potentially lead to administrative consequences, such as discrepancies in reimbursement claims or audits. The primary focus of this legislation is to ensure that personnel are fairly compensated for their expenses during authorized journeys, thereby maintaining the efficiency and morale of the Air Force personnel.
