By Authority: A. J, Arthur, Commonwealth Government Printer, Canberra

Overview

The Statutory Rules 1967 No. 11, Regulations Under the Air Force Act 1923-1965, were enacted to amend the existing Air Force Regulations in response to the need for updated pay scales and allowances for officers and enlisted personnel within the Royal Australian Air Force (RAAF). These regulations were made by the Governor-General in accordance with the advice of the Federal Executive Council, reflecting the legislative authority of the Commonwealth of Australia. The policy objective behind these amendments is to ensure that the compensation for Air Force personnel remains competitive and reflective of their service and rank, thereby maintaining morale and operational effectiveness within the force. These amendments encompass changes to the active pay of officers, consolidated rates of pay, pay of airmen other than aircrew, cadets and apprentices, pay of airmen in aircrew musterings, good conduct increments, and flying pay. Each adjustment aims to address the financial remuneration disparities and provide a structured progression of pay based on rank and years of service. The new rates of pay and allowances specified in these regulations apply to service rendered on and after specific dates mentioned within the text, ensuring a smooth transition and clarity for all affected personnel.

Scope and Application

The statutory rules provided under the Air Force Act 1923-1965 apply to officers and airmen within the Australian Air Force, regulating their pay and allowances. The rules set forth new rates of active pay for officers and airmen, consolidated rates of pay, and allowances, all of which apply to service performed on and after specific dates in 1966 and 1967. These amendments update the previous rates of pay and allowances, ensuring they reflect current conditions and service duration. Additionally, the rules address the continuation of flying pay for officers who were already receiving such pay prior to the commencement of these regulations, ensuring they receive any additional pay due based on the new rates. The application of these amendments is clear and specific, ensuring that all members of the Air Force are aware of the new financial provisions affecting their service.

Key Provisions

These Regulations, made under the Air Force Act 1923-1965, primarily amend the Air Force Regulations, specifically Regulation 543, which deals with the active pay of officers, Regulation 544, which pertains to consolidated rates of pay, Regulation 549, which concerns the pay of airmen other than aircrew, cadets, and apprentices, and Regulation 550, which addresses the pay of airmen in aircrew musterings. Additionally, Regulation 552, which governs good conduct increments, and Regulation 553A, which covers flying pay, are also amended. The Regulations impose obligations on the relevant parties by establishing new rates of pay and allowances for officers and airmen in the Air Force. These new rates are structured based on rank, length of service, and specific classifications, and they apply to service rendered on or after the specified dates mentioned in the Regulations. The updated rates are intended to reflect changes in service duration and rank, thereby ensuring that personnel are compensated appropriately according to their experience and position within the Air Force hierarchy. Failure to adhere to these Regulations could result in various consequences. While the Regulations themselves do not explicitly outline specific offences or penalties for non-compliance, breaches of the Air Force Act or associated Regulations could lead to disciplinary action under military law. This could include administrative penalties, demotions, or even dismissal from service, depending on the severity and nature of the breach. Additionally, any financial discrepancies resulting from non-compliance, such as underpayment or overpayment of allowances and increments, would need to be rectified to ensure that personnel receive the correct compensation for their service. In summary, these Regulations amend the Air Force Regulations to update pay scales and allowances for officers and airmen, impose obligations on the Air Force to implement these new rates, and while not explicitly stating penalties, breaches could lead to disciplinary actions under military law and financial rectifications.
