Overview

The Air Force Regulations, 1967, made under the Air Force Act 1923-1965, address the need for updating and streamlining the administrative procedures governing the Australian Air Force, particularly in terms of financial allowances and the disposal of government stores. Enacted by the Governor-General in Council, these regulations aim to ensure that the financial management and operational efficiency of the Air Force are in line with contemporary practices and requirements. The policy objective behind these amendments is to provide clear and updated guidelines for the management of allowances and disposals, ensuring that Air Force personnel are compensated appropriately while maintaining fiscal responsibility. These regulations reflect a commitment to providing fair and consistent treatment of Air Force members, adapting to changes in service conditions and economic factors.

Scope and Application

The Statutory Rules 1967 No. 39, made under the Air Force Act 1923-1965, amends the Air Force Regulations to update various allowances and definitions related to the disposal of government stores and allowances for married members of the Air Force. This legislation applies to members of the Australian Air Force, including officers and chaplains, and their families. The amendments affect entitlements such as the living out away from home allowance, lodging allowance, and travelling allowance, with specific rates set for different ranks based on their residence in capital cities or other locations. The regulations also redefine "Government stores" to include chattels under the control of the Air Force. This amendment extends to the entire Commonwealth of Australia, as it is a federal regulation, and no specific exclusions or exemptions are mentioned in the text. The application of these regulations can be further extended or restricted by subordinate instruments if necessary.

Key Provisions

The main operative sections of this legislation primarily amend existing regulations under the Air Force Act 1923-1965. For example, regulation 517, which pertains to the disposal of stores, is altered to broaden the scope of permissible transactions beyond simply lending, exchanging, or selling, to include any form of transfer, exchange, sale, or disposal (regulation 1). Additionally, regulation 568, concerning the living out away from home allowance for married members, is amended to update the daily rates payable to various ranks, from Air Vice-Marshal and Air Commodore down to Airman (regulation 2). Similarly, regulations 570 and 578, which govern lodging allowances and rates of travelling allowance respectively, are revised to reflect updated rates applicable to different ranks (regulations 3 and 4). Finally, regulation 590, which deals with the reduction of rates when subsistence or quarters are provided, is also amended to adjust the rates per day for various ranks (regulation 5). These regulations impose specific obligations and requirements on the parties governed by them, particularly the members of the Air Force. They must adhere to the new rates and conditions set forth for allowances such as living out away from home, lodging, and travelling. These allowances are contingent upon certain conditions determined by the Air Board, and payments are made in accordance with the updated rates specified in the amended regulations. For instance, married members of the Air Force must meet the eligibility criteria to receive the updated living out away from home allowance, lodging allowance, and travelling allowance rates as per the new regulations. The legislation does not explicitly state any offences, penalties, or consequences for breach. However, non-compliance with the updated allowances and conditions might result in legal consequences under the broader Air Force Act 1923-1965, or any other relevant legislation. This could potentially involve civil or administrative penalties, although the specifics would depend on the nature and extent of the non-compliance. It is advisable for affected parties to ensure adherence to these amended regulations to avoid any potential legal issues.
