Overview
The Statutory Rules 1979 No. 303, enacted under the Air Force Act 1923, introduce amendments to the Air Force Regulations, primarily focusing on the payment in lieu of war service leave. The Governor-General, acting on advice from the Federal Executive Council, issued these regulations to refine the criteria for the distribution of payments to members or their dependants, or to their legal personal representatives. The amendments aim to ensure that the benefits are correctly allocated and do not fall into a state of being bona vacantia, which refers to property that has no owner or heir, thus addressing potential gaps in the existing regulatory framework concerning the disbursement of these payments. The policy objective is to provide clarity and precision in the payment process to protect the entitlements of the beneficiaries.
Scope and Application
The Air Force Regulations 1979, made under the authority of the Air Force Act 1923, apply to members of the Australian Defence Force Air Command and their dependants. These regulations primarily govern the administration and operational aspects of the Air Force, including the provision of benefits such as payments in lieu of war service leave. Specifically, the regulations have been amended to adjust the criteria for beneficiaries of payments upon the death of a member, ensuring that such payments are made to the correct recipients and do not fall into a state of being bona vacantia. The regulations extend throughout the Commonwealth of Australia and are applicable to all members of the Air Force and their dependants, without any stated geographic exclusions. The application of these regulations may be further defined or extended through subordinate instruments, which could introduce additional rules or clarify existing provisions to ensure the smooth operation and administration of Air Force benefits.
Key Provisions
The primary sections of the Air Force Regulations, as amended by Statutory Rules 1979 No. 303, modify the provisions concerning payments in lieu of war service leave. Specifically, Regulation 534 has been amended to adjust the circumstances under which payments can be made to a member's dependants or their legal personal representatives (section 534(3)). It also adds a new sub-regulation, 534(3A), which stipulates that no payment can be made if the amount would be considered bona vacantia upon the member's death. Moreover, the regulation omits the previous reference to payments to a member or their dependants in sub-regulation (4). These amendments aim to clarify and refine the conditions and recipients of such payments.
These amendments impose obligations on the Air Force and the relevant authorities to ensure that payments in lieu of war service leave are made according to the updated criteria. This includes verifying the status of the member's dependants or legal personal representatives and ensuring that the payment does not result in the amount being considered bona vacantia. The authorities must also adhere to the new stipulations regarding the omission of certain previous recipients as outlined in sub-regulation (4). These obligations are intended to maintain the integrity and fairness of the payment process.
Breaches of these regulations could lead to administrative and possibly legal consequences. While the specific penalties are not detailed in the statutory rules provided, non-compliance with regulations governing payments could result in civil or administrative actions. These might include financial penalties, administrative reviews, or corrective actions to ensure that payments are made in accordance with the law. The exact penalties would depend on the nature and severity of the breach, as well as any additional provisions outlined in related legislation or administrative guidelines.
