Overview
The Air Force Regulations 1956 (Cth) were amended in 1961 by Statutory Rules 1961 No. 88 under the Air Force Act 1923-1956. Enacted by the Commonwealth Parliament, the regulations were designed to address the allowance structure for members of the Reserve employed as instructors in the Air Training Corps. The policy objective of these amendments was to ensure fair and adequate remuneration for those who participate in training activities, thereby maintaining the operational effectiveness and morale of the Air Training Corps. These regulations specifically altered the allowance rates for various ranks and appointments within the Air Training Corps, reflecting the importance of these roles in the broader context of air force training and operations. The changes were to take effect from the year ending on the thirtieth day of June 1961, ensuring that the new rates applied to all attendances and duties performed thereafter.
Scope and Application
The Regulations under the Air Force Act 1923-1956, particularly as amended by Statutory Rules 1961, No. 88, pertain specifically to members of the Reserve who are employed as instructors in the Air Training Corps. These Regulations set forth allowances and benefits for such instructors when they attend training parades of the Air Training Corps for which they are not otherwise entitled to payment. The allowances are contingent on the individual's appointment or rank and are specified in a detailed table provided within the Regulations. The amendments apply to attendances and duties performed starting from the year ending on the 30th day of June, 1961, and extend to subsequent years. The scope of the Act is confined to the allowances and benefits for Reserve instructors within the Air Training Corps, and it does not extend to other personnel or entities outside of this specific group. The Regulations have a national reach, applying throughout the Commonwealth of Australia as per the jurisdictional authority of the Air Force Act. There are no stated exclusions or exemptions in the Regulations, but they are subject to the overarching provisions and any further amendments or subordinate instruments that may be introduced under the Air Force Act.
Key Provisions
The Statutory Rules of 1961, No. 88, amend Regulation 647 of the Air Force Regulations under the Air Force Act 1923-1956. Specifically, sub-regulation (4) is amended to adjust the allowances for members of the Reserve employed as instructors in the Air Training Corps. The amendment provides a detailed table that specifies the annual allowances for various appointments or ranks, including Squadron Commandant, Deputy Commandant, Wing Commander, Squadron Leader, and others, based on whether they are associated with units formed in schools or elsewhere (Regulation 647(4)). This amendment applies to attendances and duties performed in the year ending 30 June 1961 and subsequent years (Regulation 2).
Under the amended Regulation 647(4), members of the Reserve who are instructors in the Air Training Corps and attend training parades for which they are not otherwise entitled to pay, may receive an allowance based on their appointment or rank. The allowance rates vary, with higher amounts for certain appointments such as Squadron Commandant and Deputy Commandant, and decrease progressively down the ranks to Aircraftman and Cadet Pilot Officer. For example, a Squadron Commandant would receive £50 if associated with a school unit and £50 if associated with other units, whereas an Aircraftman would receive £10 if associated with a school unit and £20 if associated with other units (Regulation 647(4)).
Entities and individuals governed by these regulations must ensure that allowances are paid according to the specified rates for the appropriate appointments or ranks. This includes verifying the eligibility of the reservists for the allowances based on their attendance at training parades and their specific roles within the Air Training Corps. Proper documentation and records must be maintained to substantiate the allowances paid (Regulation 647(4)).
Failure to comply with the allowances prescribed by Regulation 647(4) could result in legal consequences. Although the specific penalties are not detailed within the text, non-compliance with statutory regulations generally may lead to administrative or legal action. This could include fines, audits, or other corrective measures to ensure adherence to the legislative requirements. The exact penalties would depend on the nature and severity of the breach, as well as any relevant statutory provisions or common law principles (Regulation 647(4)).
