Overview

The Statutory Rules of 1964, No. 47, titled "Regulations Under the Air Force Act 1923-1956," were enacted by the Governor-General in Council, with the advice of the Federal Executive Council, on 19 March 1964. These regulations were introduced to amend various aspects of the Air Force Regulations, including rates of pay, travelling allowances, and meal allowances for members of the Air Force. The primary objective, as stated in the text, is to update and adjust the financial compensations and allowances provided to Air Force personnel in line with their rank and the circumstances of their service. The policy objective is to ensure that the remuneration and allowances for Air Force members remain fair and reflective of the roles and responsibilities they undertake, thereby maintaining morale and operational effectiveness.

Scope and Application

The Regulations under the Air Force Act 1923-1956, issued by the Governor-General in Council on 19th March 1964, pertain specifically to the Australian Air Force and its personnel, impacting the financial entitlements and allowances of officers within this branch of the military. The Regulations are designed to adjust the rates of pay, travelling allowance, meal allowance, and special evening meal allowance for various ranks, with the changes taking effect from specific dates in 1963 and 1964. These amendments apply nationally across the Commonwealth of Australia and are applicable to all members of the Air Force, irrespective of their location within the country. The Regulations also detail conditions under which allowances may be reduced or omitted, such as when subsistence or quarters are provided. Although the primary focus is on financial adjustments, the Regulations do not specify exclusions or thresholds beyond the ranks and conditions mentioned, and they extend their application through the detailed stipulations and amendments to existing sub-regulations.

Key Provisions

The Air Force Regulations, as amended by these Regulations, include several key provisions related to pay and allowances for Air Force personnel. Regulation 544 is amended to increase the rate of pay for air vice-marshals to five thousand one hundred and fifty-three pounds, effective from 23 December 1963 (subsection 1(1)). Regulation 578 is also amended to revise the rates of travelling allowance, with new rates specified for various ranks, effective from 25 June 1963 (subsection 2(3)). The rates for Air Marshals and Air Vice-Marshals are set at £4 18s 0d per day in capital cities and £3 6s 0d per day elsewhere, while other ranks have slightly reduced rates (subsection 2(1)). These amendments impose specific obligations on the Air Force to adjust the pay and allowances of its personnel in accordance with the new rates. The Air Force must ensure that the updated rates of pay and allowances are correctly applied to eligible personnel from the effective dates specified. For example, air vice-marshals must be paid the new rate of £5,153 from 23 December 1963, and members must receive the updated travelling allowances from 25 June 1963. Breach of these provisions, such as failing to pay the updated rates of allowance or pay, may result in administrative consequences, though the Regulations do not specify any criminal or civil penalties for non-compliance. The primary focus of these Regulations is on the administrative adjustment of financial entitlements within the Air Force, rather than on punitive measures for non-compliance.
